HomeMy WebLinkAboutRES NO 20-87RESOLUTION NO. 20-87 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 13 (ON WILSON ROAD BETWEEN STINE AND WIBLE ROADS). WHEREAS, by Resolution of Intention No. 1018 adopted on .January 21, 1987, a public hearing was called for February 11, 1987, at the hour of 7:00 P.M., in the Council Chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, to ascertain whether the public necessity, health, safety or general welfare requires the removal of poles, overhead wires and asso- ciated overhead structures and underground installation of wires and facilities for supplying electric, communication, cable tele- vision or similar and associated services, within that certain area, more particularly described as follows: DESCRIPTION - DIVISION 13 Beginning at the intersection of the south line of Wilson Road and the east line of Wible Road; Thence (1) northerly along said east line of Wible Road to intersect the north line of Wilson Road; Thence (2) westerly along said north line of Wilson Road to intersect the west line of New $tine Road; Thence (3) southerly along said west line of New Stine Road to intersect the south line of Wilson Road; Thence (4) easterly along said south line of Wilson Road to the point of beginning. Notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to appear and be heard. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that, pursuant to Chapter 12.32 of Title 12 of the Municipal Code of the City of Bakersfield, the above-described area is hereby declared an underground utility district and is designated as Underground Utility District No. 2, Division 13, of the City of Bakersfield. Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this Resolution, is a map diagram entitled as follows: UNDERGROUND UTILITY DISTRICT NO. DIVISION 13, delineating the boundaries of said District. or BE IT FUR?HER RESOLVED that the electric utility which undertakes underground installation of its facilities shall use the underground conversion allocation computed to decisions of the Public Utilities Commission of the State of California for the purpose of providing to each premises in Underground Utility District No. 2, Division 13, requiring it a maximum of one hundred feet of individual electric 3errice trenching and conduc- tor, as well as backfill, paving and conduit. ~ro~er~_ owner in Under~round Utili~ District No. 2, Division 13, shall be responsible for the installation and maintenance of the conduit and termination box located on, under or within any structure on the premises served. BE IT FUR~FHER RESOLVED that the Council does hereby fix 3anuary 31, 1988, as the date on which all affected utilities must have all facilities installed, and have completed removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, cable television or similar or associated services within Underground Utility District No. 2, Division 13. BE IT FURTHER RESOLVED that the Council does hereby fix September 30, 1987, as the date on which all affected propert~_ owners must be read~ to receive underground se~, and does hereby order the removal of all poles, overhead wires and associ- ated overhead structures and the underground installation of wires and facilities for supplying electric, communication, cable televi- sion or similar associated service within Underground Utility District No. 2, Division 13, no later than September 30, 1987. BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 2, Division 13, of the adoption of this Resolution within ten (10) days after the date of such adoption. ~aid City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, cabke television, or other similar or associated service, they or such occupant shall, by the date fixed on this Resolution, provide all necessary facility changes on their ~remises so as to ceceive service from the lines of the supplying utility or utilities at a new location, subject to applicable ~ules, regulations and tariffs of the respective utility or utili- ties on file with 'the Public Utilities Commission of the State of California. - 2 - Such notification shall be made by mailing a copy of this Resolution, together with a copy of Chapter 12.32 of the Municipal Code of the City of Bakersfield, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. BE IT FURTHER RESOLVED that the Council hereby finds and determines as follows: 1. That the public necessity, health, safety or general welfare requires the removal and undergrounding of poles, overhead wires and associated overhead structures within Underground Utility District No. 2, Division 13. 2. The Underground utility District herein created is in the general public interest for the reason that the streets, roads or rights-of-way in the Distict are extensively used by the general public and carry a heavy volume of pedestrian and vehicu- lar traffic. .......... o0o ..........
