A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT VIII OF PRO-
POSED AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLAN AND
CASA LOMA SPECIFIC PLAN (LAND USE AMENDMENT
4-86).
WHEREAS, the Council of the City of Bakersfield referred
Segment VIII of a proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan and Casa Loma
Specific Plan to the Planning Commission; and
WHEREAS, the Planning Commission of the City of
Bakersfield, in accordance with the provisions of Section 65351
of the Government Code, held a public hearing on December 18,
1986, on Segment VIII of a proposed amendment to the Land Use
Element of the General Plan and Casa Loma Specific Plan, notice
of the time and place of hearing having been given at least ten
(10) calendar days before said hearing by publication in the
Bakersfield Californian, a local newspaper of general circu-
lation; and

WHEREAS, s'~ch Segment VIII of the proposed amendment to
Use Element of the Bakersfield Metropolitan Area General
Casa Loma Specific Plan is as follows:
SEGMENT VIII
The CITY OF BAKERSFIELD is proposing to
amend the Land Use Element of the
Bakersfield Metropolitan Area General Plan
and the Casa Loma Specific Plan from 5.4
(Residential - maximum 4 units/net acre) to
5.3 (Residential - maximum 10 units/net
acre) for 15.27 +/- acres generally
located east of Cottonwood Road, between
Casa Loma Drive and Watts Drive.
Being more particularly described as follows:
FROM 5.4 (RESIDENTIAL - MAXIMUM 4 UNITS/
NET ACRE) TO 5.3 (RESIDENTIAL - MAXIMUM
10 UNITS/NET ACRE) FOR 10.5 ACRES:
The north 985.00 feet of Lot 9 as shown
on the sales map of the Kern County Land
Company in Section 9, Township 30 south,
Range 28 east, M.D.B.&~ filed for record
April 20, 1894 in the Office of the
County Recorder of said Kern County.
EXCEPTING THEREFROM, all that area
located within the right-of-way of
Cottonwood Road.
WHEREAS, for the above described Segment, an Initial
Study was conducted and it was determined that the proposed pro-
ject would not have a significant effect on the environment and a
Negative Declaration was prepared; and
WHEREAS, the law and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution 107-86 have been duly followed
by the City staff and the Planning Commission;
WHEREAS, by Resolution No. 82-86 on December 18, 1986,
the Planning Commission recommended approval and adoption of
Segment VIII by this Council and this Council has fully con-
sidered the findings made by the Planning Commission as set forth
in that Resolution; and
WHEREAS, the Council of the City of ~akersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted and held a public hearing on February 11, 1987,
on the above-described Segment VIII of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan, notice of time and place of the hearing having been given
an least ten (10) calendar days before the hearing by publication
in the Bakersfield Californian, a local newspaper of general cir-
culation; and
NOW, THERE:FORE, BE IT RESOLVED and found by the Council
of the City of Baksrsfield as follows:
1. The above recitals and findings, incorporated
herein, are true and correct.
2. The Negative Declaration for Segment VIII is hereby
approved and adopted.
3. The report of the Planning Commission, including
maps and all reports and ~apers relevant thereto, transmitted by
the Secretary of the Planning Commission to the City Council, is
hereby received, accepted and approved.

4. The City Council hereby approves and adopts Segment
VIII of the proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan.
5. That Segment VIII, approved herein, be combined with
other approved segments, described in separate resolutions, to
form a single Land Use Element Amendment, 4-86.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on February 11, 1987 , by
the following vote:
