HomeMy WebLinkAboutRES NO 180-86RESOLUTION NO. 180-86 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS PROCEEDING NO. 910, ANNEXATION NO. 310, IN ACCORDANCE WITH LAFCO RESOLUTION MAKING DETERMINATION (CALIFORNIA STATE COLLEGE). WHEREAS, a proposal was submitted to the Local Agency Formation Commission of Kern County ("Commission") for the annex- ation of territory to the City of Bakersfield designated as Annexation No. 310 (California State College); and WHEREAS, a duly noticed public hearing upon said pro- posal was held before the Commission on the 28th day of October, 1986; continued until 11th day of November, 1986; and WHEREAS, following said public hearing the Commission, on November 11, 1986, adopted its Resolution Making Determination, being Resolution No. 86-39, recorded in Minute Book 33 of said Commission. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Preliminary proceedings for annexation of territory to the City of Bakersfield designated as Annexation No. 310 (California State College) were authorized by the City Council of the City of Bakersfield by action at a regular meeting thereof held on May 21, 1986; Application for Annexation dated May 21, 1986, was transmitted to LAFCO; the Certificate of Filing of the Executive Officer of the Commission shows that the proposal was filed by him on the 29th day of September, 1986. 2. The distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: "City of Bakersfield Annexation No. 310 (California State Bakersfield)." 3. The description of the exterior boundaries of the territory proposed to be annexed is contained in Exhibit "A", attached hereto, and incorporated in this Resolution as though fully set forth herein. 4. The territory proposed to be annexed is inhabited as determined by the Commission in its Resolution Making Determination. 5. The reasons for the proposed annexation as set forth in the proposal thereof submitted to the Commission are that the owners of the affected territory desire to receive, and in some instances already are receiving, municipal services from the City of Bakersfield. 6. BE IT FURTHER RESOLVED, that Wednesday, the 7th day of January, 1987, at the hour of 7 p.m. (or as soon thereafter as the matter may be heard) in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time, date and place of hearing on the proposed annexation where any owner of land within, or any registered voter residing within, the said described territory may appear before the Council of the City of Bakersfield and show cause why such territory should not be annexed. Any owner of land within, or any registered voter residing within, the described territory may file a written protest against the annexation with the City Clerk of the City of Bakersfield at 1501 Truxtun Avenue at any time prior to the conclusion of the hearing on the proposed annexation. 7. That the City of Bakersfield, as lead agency, has completed an environmental assessment and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves and adopts the Negative Declaration. The project will not have a significant effect on the environment. 8. The land and improvements within the territory to be annexed shall be liable for the general indebtedness of the City existing at the time of annexation, to the extent the same are subject to taxation. 9. A certified copy of this Resolution shall forthwith be transmitted to the Executive Director of LAFCO. .......... o0o .......... I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at regular meeting thereof held on the 3rd day of December , 1986, by the following vote: CITY CLERK and Ex Officio Clerk of the Council of the City of Bakersfield APPROVED this 3rd day of __D~c~b~__, 1986 MAYOR of the City of B~kersfield APPROVED as to form: EA/meg 4:R.AIPCALS 3 CALIFORNIA STATE COLLEGE ANNEXATION NO. 310 A parcel of land situated in the County of Kern, State of California, being a portion of Section 32, Township 29 South, Range 27 East, and Section 5, Township 30 South, Range 27 East, M.D.M., more particularly described as follows: Beginning at the intersection of the North line of the South 80.00 feet of the Southeast quarter of said Section 32, also being the North right of way line of Stockdale Highway, with the East right of way line of the Arvin-Edison Water Storage District Canal, as said canal right of way is defined in Parcel 1C-1 of that certain order of condemnation recorded in Book 3840, at Page 291 in the Office of the Kern County Recorder. Said point of intersection being a point on the existing Corporate Boundary of the City of Bakersfield, and the point of beginning for this description; Thence (1) Southerly, Westerly, Northerly and Easterly along the last named Corporate Boundary to the point of beginning.
