A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS THAT NO WRITTEN
PROTEST HAS BEEN FILED AND ORDERING THE
TERRITORY DESIGNATED AS PROCEEDING NO. 909,
ANNEXATION NO. 309 (MT. VERNON NO. 3),
ANNEXED TO THE CITY OF BAKERSFIELD.
WHEREAS, Resolution of Application No. 58-86, dated
June 4, 1986, was submitted to the Local Agency Formation
Commission of Kern County ("Commission") for the annexation of
territory to the City of Bakersfield designated as Proceeding
No. 909, Annexation No. 309 (Mt. Vernon No. 3); and
WHEREAS, a duly noticed public hearing upon said pro-
posal was held before the Commission on the 14th day of October,
1986; and
WHEREAS, following said public hearing, the Commission,
on October 28, 1986, adopted its Resolution Making Determination,
being Resolution No. 86-38, recorded in Minute Book 33 of said
Commission; and
WHEREAS, on November 12, 1986, the Council of the City
of Bakersfield adopted its Resolution No. 169-86 initiating pro-
ceedings for annexation of the said territory to the City of
Bakersfield and setting Wednesday, the 3rd day of December,
1986, at the hour of 7 p.m. (or as soon thereafter as the matter
could be heard) in the Council Chambers of the City Hall,
1501 Truxtun Avenue, Bakersfield, California, as the time, date
and place of hearing on the proposed annexation and the owners of
land within the said territory were duly informed of their right
to file written protests against the annexation with the City
Clerk at any time prior to the conclusion of the hearing on the
proposed annexation; and
WHEREAS, the public hearing was duly and regularly con-
ducted by and before the City Council at its meeting of
December 3, 1986, in all respects in accordance with Resolution
No. 169-86.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the
Council of the City of Bakersfield as follows:
1. In accordance with Section 57075 of the Government
Code, it is hereby found that written protests, if any, have been
filed and not withdrawn by owners of land and improvements who
own less than 50% of the total assessed land and improvements
within the territory.
2. The description of the exterior boundaries of the
territory annexed is contained in Exhibit "A", attached hereto
and incorporated in this Resolution as though fully set forth
herein.
3. That the said teritory designated as Proceeding
No.909, Annexation No. 309 (Mt. Vernon No. 3), and described
herein, and every part thereof, is hereby ordered annexed to the
City of Bakersfield.
4. That the Clerk shall forthwith transmit a certified
copy of this resolution ordering a change of organization, along
with any required remittance to cover the fees required by
Section 54902.5 of the Government Code, to the executive officer
of the Local Agency Formation Commission of Kern County.
5. That the executive officer of the Commission is
hereby requested to prepare and execute a certificate of comple-
tion and make the filings required by Part 4, Chapter 8 of the
Cortese-Knox Local Government Reorganization Act of 1985 and
record a certified copy of the certification of completion with
the recorder of Kern County, with the surveyor of Kern County and
with the Clerk of the City of Bakersfield.

A parcel of land situated in the Northeast quarter of Section 4, Township 30
South, Range 28 East, M.D.B.&M., County of Kern, State of California, more
particularly described as follows:
Beginning at the East quarter corner of said Section 4 also being a point on the
existing Corporate Boundary of the City of Bakersfield;
Thence'(1) Departing said existing Corporate Boundary, West along the South line
of the Northeast quarter of said Section 4 to the center of said Section;
Thence (2) North 01°07'59" East along the West line of said Northeast quarter s
distance of 1,203.53 feet to a point on the South right-of-way line of Washington
Street (Co. Rd.No. 2927);
Thence (3) South 88°52'01" East, along said right-of-wsy line, a distance of
12.00 feet;
Thence (4) North 03°41'15" East continuing along said right-of-way line a dis-
tance of 706.69 feet to a point on the South right-of-way line of State Freeway
58;
Thence following said South freeway right-of-way line for the next (9) courses;
Thence (5) North 89°18'45" East, 402.39 feet;
Thence (6) North 86"36'03" East 441.52 feet;
Thence (7) North 88°48'31" East 616.52 feet;
Thence (8) North 83"14'20" East 100.50 feet;
Thence (9) North 88°56'56" East 602.85 feet;
Thence (10) South 88°44'33" East 372.72 feet;
Thence (11) South 20°52'48" East 56.29 feet;
Thence (12) South 11°40'22" East 125.12 feet;
Thence (13) South 88"58'35" East 22.50 feet to a point on the existing
Corporate Boundary of the City of Bakersfield;
Thence (14) Southerly along the last named Corporate Boundary to the Point of
Beginning.
