HomeMy WebLinkAboutRES NO 177-86RESOLUTION NO. 177-86 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD SETTING AND AUTHORIZING NOTICE OF A HEARING TO CONSIDER AND ACT UPON THE ADOPTION OF A RESOLUTION OF NECESSITY TO ACQUIRE CERTAIN PROPERTY BY EMINENT DOMAIN WHEREAS, the Community Redevelopment Law (Health and Safety Code Sections 33000, e__t seq.) provides in Section 33391 (b) that a Redevelopment Agency may acquire real property by eminent domain within the redevelopment survey area or for the purposes of redevelop- ment; and WHEREAS, the Redevelopment Agency of the City of Bakersfield (the "Agency") is carrying out the Redevelopment Plan for the Bakersfield Downtown Redevelopment Project (the "Project"); and WHEREAS, the Council wishes to consider the acquisition by eminent domain of certain real property described in Exhibit A (the "Property") for the purposes of redevelopment; and WHEREAS, Section 1245.235 of the Code of Civil Procedure requires that prior to the governing body of a public entity considering the adoption of a resolution of necessity, it must give notice to the pro- perty owners of the property and give them a reasonable opportunity to appear and be heard on the resolution of necessity; and WHEREAS, the Council desires to hold a hearing in order to give any and all property owners that wish to be heard an opportunity to appear before the Agency; NOW, THEREFORE, THE COUNCIL OF THE CITY OF BAKERSFIELD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That a hearing December ]7 , 1986, at 5:00 City Hall, City of Bakersfield, is hereby scheduled for p.m. in the Council Chambers, for the purpose of considering and acting upon the adoption of a resolution of necessity for the taking of certain property for redevelopment purposes. Section 2. That the City Clerk is authorized and directed to cause a notice of the hearing to be sent to the property owners, whose name and address appear on the last equalized county assessment role.
