RESOLUTION NO. 167-86
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING THE VACATION OF A PORTION
OF THE PUBLIC UTILITIES EASEMENT RESERVED IN
THE ABANDONED PORTION OF BRIAN WAY AND
ADJACENT ALLEY BETWEEN PIERCE ROAD AND
FREEWAY 99 IN THE CITY OF BAKERSFIELD.
WHEREAS, on the 8th day of October, 1986, the Council of
the City of Bakersfield, pursuant to the provisions of the
"Public Streets, Highways and Service Easements Vacation Law",
being Chapter 3 of Part 3 of Division 9 of the Streets and
Highways Code of the State of california, passed and adopted its
Resolution of Intention No. 1015 declaring its intention to order
the vacation of a portion of the public utilities easement
reserved in the abandoned portion of Brian Way and adjacent alley
between Pierce Road and Freeway 99 in the City of Bakersfield,
California; and
WHEREAS, said Council did fix a time and place for hear-
ing all persons interested in or objecting to said proposed vaca-
tion, which said hearing was held on the 12th day of November,
1986, after notices were duly published and posted as required by
law; and
WHEREAS, this Council after duly considering the matter,
does hereby find and. resolve as follows:
1. That a portion of the public utilities easement
reserved in the abandoned portion of Brian Way and adjacent alley
between Pierce Road and Freeway 99 in the City of Bakersfield,
County of Kern, State of California, more particularly described
in Exhibit "A" attached hereto and made a part hereof, is unnec-
essary for present or prospective public street purposes.
2. That a portion of the public utilities easement
reserved in the abandoned portion of Brian Way and adjacent alley
between Pierce Road and Freeway 99 be and the same is hereby
closed up, vacated and abandoned for public street purposes, sub-
ject to and in conformity with any reservations and exceptions
contained in and contemplated by said Resolution of Intention
No. 1015. Reference contemplated by said Resolution of Intention
is hereby made for further particulars.
3. That the City Clerk shall certify to the passage of
this Resolution and shall cause a certified copy hereof, attested
by the Clerk under the seal of the City, to be recorded in the
office of the County Recorder of the County of Kern, California.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on Novembec 12, 1986

EXHIBIT "A"
A parcel of land situated in the Southeast ~ of Section 23, T.29S., R.27E.,
City of Bakersfield, County of Kern, State of California, more particularly
described as follows:
Cor~encing at the northeast corner of Lot 1 as shown on map of
Tract No. 1198 recorded September 5, 1941 in Book 5 of maps at pages 42 and
43 in the office of the Kern County Recorder; Thence South 00°02'00" West
along the East lines of lots 1 and 2 and Southerly prolongation thereof
(Also being on the West right of way line of Pierce Road) a distance of
110.00 feet to a point on the South line of the North 10.00 feet of Brian
Way (said street and adjacent alley vacated by County Resolution No. 64-228
recorded in Book 3735 at Page 516 of official records in the office of the
Kern County Recorder) and said point being THE TRUE POINT OF BEGINNING;
Thence North 89°40'52" West along said South line 189.72 feet
(more or less to a point on the East right of way line of State Freeway 99;
Thence North 08°24'27" West along said East line 10.12 feet to a
point on the North right of way line of vacated Brian Way~
Thence South 89°40'52" East along said North line 36.25 feet to
the West line of said vacated alley;
Thence North 00°02'00" East along said West line, 100.00 feet;
Thence South 89°40'52" East, 20.00 feet to East line of said
alley;
Thence South 00°02'00" West along said East line 100.00 feet to
the North right of way line of said vacated Brian Way;
Thence South 89°40'52" East along said North line 114.90 feet to
the beginning of a 20.00 foot radius curve concave to the northwest;
Thence northeasterly along said curve through a central angle of
90°17'08" an arc length of 31.51 feet to a point on the West right of way
ling of Pierce Road;
Thence South 00°02'00" West, 30.10 feet to the TRUE POINT OF BEGINNING.
