A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING INSTALLATION OF CURB,
GUTTER AND CONNECTING PAVING ALONG MESA GRANDE
STREET IN FRONT OF PARCEL C, TRACT NO. 2263.
WHEREAS, the City Engineer has determined that the pub-
lic convenience and necessity require the installation of curb
and gutter, including connecting paving (hereinafter the
"improvements") along Mesa Grande Street adjacent to property
described as Parcel C of Tract No. 2263 (hereinafter, the
"property"); and
WHEREAS, the Public Works Manager has found that curbs,
including gutters and connecting paving, have been constructed in
front of properties constituting more than fifty percent of the
frontage in the block wherein the property is located; and
WHEREAS, pu~suant to Chapter 27 of Part 3 of Division 7
(Section 5870 et seq.) of the california Streets and Highways
Code (hereinafter, the "Code"), this Council may order installa-
tion of such improvements, instruct the Public Works Manager
(hereby designated tlne "Superintendent of Streets" to perform the
duties of the superintendent of streets set forth in that
Chapter) of the Code to notify the owner or person in possession
of the property to construct or cause to be constructed such
improvements in front of his property, and set a hearing to hear
and pass upon objections or protests, if any.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. The owner of the property is hereby ordered to
install such improvements, to City standards, the length of said
property along Mesa Grande Street.
2. The Public Works Manager is hereby directed to
notify such person to construct or have constructed such improve-
ments, a copy of which notice is attached to this resolution.
Such notice shall also be posted as specified in Section 5878 of
the Code.
3. This Council will hear and pass upon any objections or
protests at 7 p.m., or as soon thereafter as the matter may be
heard, on Wednesday, October 22, 1986, at the Council Chambers,
1501 Truxtun Avenue, Bakersfield, California.

NOTICE TO CONSTRUCT IMPROVEMENTS
Pursuant to order of the City Council of the City of
Bakersfield adopted at its regular meeting of October 8, 1986,
you are hereby directed to construct curb and gutter (with con-
necting paving) adjacent to your property (Parcel C of Tract
No. 2263) along Mesa Grande Street in the City of Bakersfield.
Details of the work to be done and materials to be used are given
on Exhibits "A" and "B" attached hereto and incorporated herein
by reference.
If construction of such improvements is not commenced
within sixty (60) days and diligently and without interruption
prosecuted to completion. I shall cause the construction to be
done and the cost of the same shall be a lien on the property and
may be collected with other taxes on the property.
The Council of the City of Bakersfield shall conduct a
hearing and will pass upon objections or protests, if any, which
may be raised by any property owner or other interested persons
at 7 p.m., or as soon thereafter as the matter may be heard, on
October 22, 1986, at the Council Chambers, City Hall,
1501 Truxtun Avenue, Bakersfield, California.

EXHIBIT B
(a) CLEARING AND GRUBBING. Clearing and grubbing shall conform to the
provisions in Section 16, "Clearing and Grubbing," of the Standard
Specifications and these special provisions.
Clearing and grubbing shall be limited to those areas actually
affected by the planned construction as directed by Engineer.
(b) EARTHWORK. Earthwork shall conform to the provisions in Section 19,
"Earthwork," of the Standard Specifications and these special provisions.
Section 4-1.05. "Use of Materials Found on the Work," of the Standard
Specifications shall be amended to read as follows:
Unless designated as selected material as provided in Section 19-2.07,
"Selected Material," the Contractor, with the approval of the
Engineer, may use in the proposed construction such stone, gravel,
sand or other material suitable in the opinion of the Engineer as may
be found in excavation. The Contractor will be paid for the excava-
tion of such materials at the contract price for such excavation, but
he shall replace at his expense with other suitable material all of
that portion of the material so removed and used which was contem-
plated for use in the work. The Contractor shall not excavate or
remove any smterial from within the highway location that is not
within the excavation, as indicated by the slope and grade lines,
without written authorization from the Engineer.
When asphalt concrete is to be placed on the grading plane, the grad-
ing plane at any point shall not vary by more than 0.05-foot above or below the
grade established by the Engineer.
Section 19-3.062, "Slurry Cement Backfill," of the Standard
Specifications is deleted and shall not apply to this contract.
The relative compaction limits specified in the second paragraph of
Section 19-5.03 "Relative Compaction ( 95 Percent)," of the Standard
Specifications are amended to the limits shown on the plans and typical cross-
sections and shall be determined by: ASTM D1557-70, Method "C" Standard Test
Method for Moisture-Density Relations of Soils using 10 lb. (4.5 Kg) rammer and
18" (457mm) drop, Calif. Test Methods 216 or 231. The subgrade must be smooth,
uniform and true to the required grade.
Full compensation for excavating & compacting the pavement subgrade
shall be included in the price paid for asphalt concrete and no additional allow-
ance will be allowed therefor.

(c) ASPHALT CONCRETE. Asphalt concrete shall be Type B and shall
conform to the provisions in Section 39, "Asphalt Concrete," of the Standard
Specifications and these special provisions.
Aggregate for Type B asphalt concrete shall conform to the require-
ments for 3/4 inch maximum, medium grading as specified in Section 39-2.02,
"Aggregate," of the Standard Specifications.
The amount of asphalt binder to be mixed with the aggregate shall be
between 4 percent and 7 percent by weight of the dry aggregate as determined by
the Engineer.
The second sentence of the first paragraph of Section 39-6.02,
"Spreading," of the Standard Specifications is amended to read:
The asphalt concrete may be spread by any mechanical means that pro-
duces a surface texture of uniform appearance ready for compaction
without further shaping.
Where new asphalt concrete pavement is to conform to existing paved
surfaces, the existing pavement shall be saw cut.
Asphalt concrete type "B" will be measured by the ton of completed
mixture in accordance with the provisions of Section 9-1.01 "Measurement of
Quantities," of the Standard Specifications.
Asphalt concrete Type B will be paid for at the contract price per ton
which price shall include full compensation for furnishing all labor, materials,
tools and equipment and for doing all the work involved in placing asphalt con-
crete as specified, including sawcutting and trimming of bituminous surfacing at
pavement joints.
Full compensation for furnishing and applying asphaltic paint binder
shall be considered as included in the contract price paid per ton of asphalt
concrete Type "B".
Full compensation for excavating and compacting the pavement subgrade
shall be considered as included in the contract price paid per ton of asphalt
concrete Type "B" and no additional compensation will be allowed therefore.

(d) SAW AofHALT CONCRETE PAVEMENT. Where _¢w asphalt concrete is to
conform to existing asphalt concrete, the existing asphalt concrete shall be saw
cut to a neat line. The depth of cut shall be sufficient so that damage to
adjacent asphalt concrete, which is to remain in place, will not occur during
excavation operations.
The Contractor shall conduct his operations so as not to damage the
integrity of the edge of the saw cut pavement. Any damage to the saw cut edge
will be corrected by the Contractor by additional cutting prior to the start of
paving operations.
Full compensation for conforming to the requirements of this article
shall be considered as included in the contract price paid per ton for asphalt
asphalt concrete pavement and no additional allowance will be made therefore.
(e) TYPE B CURB & GUTTER. Portland cement concrete curb & gutter,
Type B, shall conform to the provisions in Section 73, "Concrete Curbs and
Sidewalk," of the Standard Specifications and these special provisions.
Type B curb and gutter shall be constructed in accordance with City
of Bakersfield Standards S-1 and S-36. Quantities of curb and gutter, Type B
for payment will be the actual length in feet constructed, as determined from
field measurement taken along the face of the curb.
