HomeMy WebLinkAboutRES NO 146-86RESOLUTION NO. 146-86 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS PROCEEDING NO. 908, ANNEXATION NO. 308, IN ACCORDANCE WITH LAFCO RESOLUTION MAKING DETERMINATION (PANAMA NO. 6). WHEREAS, a proposal was submitted to the Local Agency Formation Commission of Kern County ("Commission") for the annex- ation of territory to the City of Bakersfield designated as Annexation No. 308 (PANAMA NO. 6); and WHEREAS, a duly noticed public hearing upon said pro- posal was held before the Commission on the 9th day of September, 1986, and continued to the 23rd day of September, 1986; and WHEREAS, following said public hearing the Commission, on September 23, 1986, adopted its Resolution Making Determination, being Resolution No. 86-33, recorded in Minute Book 33 of said Commission. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Preliminary proceedings for annexation of territory to the City of Bakersfield designated as Annexation No. 308 (PANAMA NO. 6) were authorized by the City Council of the City of Bakersfield by action at a regular meeting thereof held on May 7, 1986; Application for Annexation dated May 20, 1986, was trans- mitted to LAFCO; the Certificate of Filing of the Executive Officer of the Commission shows that the proposal was filed by him on the 11th day of August, 1986. 2. The distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: "City of Bakersfield Annexation No. 308 (PANAMA NO. 6)." 3. The description of the exterior boundaries of the territory proposed to be annexed is contained in Exhibit "A", attached hereto, and incorporated in this Resolution as though fully set forth herein. 4. The territory proposed to be annexed is uninhabited as determined by the Commission in its Resolution Making Determination. 5. The reasons for the proposed annexation as set forth in the proposal thereof submitted to the Commission are that the owners of the affected territory desire to receive, and in some instances already are receiving, municipal services from the City of Bakersfield and the City desires to receive tax revenues for benefits given and to be given to the territory proposed to be annexed. 6. BE IT FURTHER RESOLVED, that Wednesday, the 12th day of November, 1986, at the hour of 7 p.m. (or as soon thereafter as the matter may be heard) in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time, date and place of hearing on the proposed annexation where any owner of land within, or any registered voter residing within, the said described territory may appear before the Council of the City of Bakersfield and show cause why such territory should not be annexed. Any owner of land within, or any registered voter residing within, the described territory may file a written protest against the annexation with the City Clerk of the City of Bakersfield at 1501 Truxtun Avenue at any time prior to the conclusion of the hearing on the proposed annexation. 7. That the City of Bakersfield, as lead agency, has completed an environmental assessment and a Negative Declaration was adopted by the P~anning Commission after a public hearing thereon and this Council hereby approves and adopts the Negative Declaration. The project will not have a significant effect on the environment. 8. The land and improvements within the territory to be annexed shall be liable for the general indebtedness of the City existing at the time of annexation. 9. A certified copy of this Resolution shall forthwith be transmitted to the Executive Director of LAFCO. .......... o0o .......... S08 A parcel of land situated in the County of Kern, State of California, being a portion of Sections 19 and 30, Township 30 South, Range 28 East, M.D.M., more particularly described as follows: Beginning at the northeast corner of Lot 8 of Sales Map No. 1 of lands of J. B. Haggin, Section 19, Township 30 South, Range 28 East, M.D.B.&M., Kern County, California, filed May 3, 1889, in Book M of Maps at Page 5 in the Office of the Kern County Recorder. Said corner also being a point on the existing corporate boundary of the City of Bakersfield, and the point of beginning for this description: Thence (1) South along the East line of said Lot 8, also being the East line of the Southwest 1/4 of the Northeast 1/4 of said Section 19, a distance of 1321.42 feet to a point on the center line of Fairview Road; Thence (2) Sales Map, Section 19 Lane; South along the East lines of Lots 13 and 18 of said J. B. Haggin also being the East line of the West 1/2 of the Southeast 1/4 of said , a distance of 2641.72 feet to a point on the center line of Panama Thence (3) along a Southerly projection of said Lot 18 East line, a distance of 30.00 feet to a point on the South right of way line of Panama Lane; Thence (4) West along said South right of way line a distance of 1320.00 feet to a point on the existing Corporate Boundary of the City of Bakersfield; Thence (5) Northerly and Easterly along the last named Corporate Boundary to the Point of Beginning.
