HomeMy WebLinkAboutRES NO 115-86RESOLUTION NO. 115-86 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT V OF PRO- POSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 2-86). WHEREAS, the Council of the City of Bakersfield referred Segment V of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on June 19, 1986, on Segment V of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment V of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: Segment V: HILLTOP DEVELOPMENT represented by Dale Scales has requested to change the Land Use Element designation from Industrial to Commercial on 2.5 acres and to Medium Density Residential on 18.7 acres generally located south of White Lane, north of Panama Lane and between S.P.R.R. and South "H" Street. WHEREAS, for the above-described Segment, an Initial Study was conducted, and it was determined that, with mitigation measures incorporated as conditions in the project and accepted by the applicant, the proposed project would not have a signifi- cant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 132-83 have been duly fol- lowed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 57-86 on June 19, 1986, the Planning Commission recommended approval and adoption of Segment V by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on July 30, 1986, on the above-described Segment V of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given an least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment V is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all the Secretary of hereby received, 4. The Segment V of the reports and papers relevant the Planning Commission accepted and approved. thereto, transmitted by to the City Council, is City Council hereby approves and adopts proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, with incorpora- tion therein of the following conditions of development: Siting and design of development to minimize exposure to sensitive land uses. An acoustical analysis submitted by the applicant list condi- tions to mitigate potential noise impacts. Multiple-family residential buildings are required to conform to CAC Title 24 which gov- erns certain noise standards. A second improved public street connection to either Hughes Lane or South "H" Street shall be provided by the applicant within one year of the approval of this GPA. They shall enter into an agreement with the city and post secu- rity to ensure completion within that year. The applicant shall post with the City Engineer a bond, payable to the city in the amount of $100,000 to assure payment to the city for the construction of a traffic signal at the inter- section of Aimee Street and white Lane. The applicant shall have a traffic study performed within three months of approval of this GPA to evaluate a traffic signal at that location and the adverse or positive effects it would have on a system of signals on White Lane and South "H" Street. If it is determined that a traffic signal would be beneficial at that location and not detrimental to traffic flow on White Lane or south "H" Street, then the applicant shall make payment on demand by the city for the construction of said traffic signal. If a traffic signal is not constructed, the turning movements allowed shall be limited to: east- bound to southbound and northbound to eastbound right turns and westbound to southbound left turns. A waiver of direct vehicular access to White Lane from the abutting parcel. Remove all encroachments from South "H" Street and Aimee Street as shown on Tentative Parcel Map 7983. Construct the westerly portion of South "H" Street to arterial standards with median island from white Lane to Pacheco Road and Pacheco Road to major collector standards adjacent to Parcel 2 of Parcel Map 7353. In conjunction with improving South "H" Street, construct storm drain lines and structures to conform to the master drainage plan approved by the city and construct the 12" sewer main from the existing 15" main line in South "H" Street southerly to Pacheco Road. Install all water mains required to provided service for both domestic use and fire protection to all parcels adjacent to South "H" Street. Prior to improving South "H" Street, install all necessary utility lines in or crossing the street. File for approval by the City Engineer all plans, profiles and specifications for all required improvements. The above items shall be completed by the applicant within one year of the approval of this GPA. He shall enter into an agreement with the city and post security to ensure com- pletion within that year. 5. That Segment V, approved herein, be combined with other approved segments, described in separate resolutions, to form a single Land Use Element Amendment, 2-86. ........... o0o ..........
