A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT II OF PRO-
POSED AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLaN
(LAND USE AMENDMENT 2-86).
WHEREAS, the Council of the City of Bakersfield referred
Segment II of a proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan to the Planning
Commission; and
WHEREAS, the Planning Commission of the City of
Bakersfield, in accordance with the provisions of Section 65351
of the Government Code, held a public hearing on June 19, 1986,
on Segment II of a proposed amendment to the Land Use Element of
the General Plan, notice of the time and place of hearing having
been given at least ten (10) calendar days before said hearing by
publication in the Bakersfield Californian, a local newspaper of
general circulation; and
WHEREAS, such Segment II of the proposed amendment to
the Land Use Element of the Bakersfield ~etropolitan Area General
Plan is as follows:
Segment I~:
PAUL SHARICK has applied to amend the Land Use
Element designation of the General Plan from
Low Density Residential to Commercial on 2.99
acres located on the northwest corner of Panama
Lane and Summerfield Drive.
WHEREAS, for the above-described Segment, an Initial
Study was conducted, and it was determined that, with mitigation
measures incorporated as conditions in the project and accepted
by the applicant, the proposed project would not have a signifi-
cant effect on the environment, and a Negative Declaration was
prepared; and
WHEREAS, the law and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution No. 132-83 have been duly fol-
lowed by the City staff and the Planning Commission; and
WHEREAS, by Resolution No. 54-86 on June 19, 1986,
the Planning Commission recommended approval and adoption of
Segment II by this Council and this Council has fully considered
the findings made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted and held a public hearing on July 30, 1986, on
the above-described Segment II of the proposed amendment to the
Land Use Element of the Bakersfield Metropolitan Area General
Plan, notice of time and place of the hearing having been given
an least ten (10) calendar days before the hearing by publication
in the Bakersfield Californian, a local newspaper of general
circulation.
NOW, THEREFORE, BE IT RESOLVED and found by the Council
of the City of Bakersfield as follows:
1. The above recitals and findings, incorporated
herein, are true and correct.
2. The Negative Declaration for Segment II is hereby
approved and adopted.
3. The report of the Planning Commission, including
maps and all reports and papers relevant thereto, transmitted by
the Secretary of the Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The City Council hereby approves and adopts
Segment II of the proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan, with incorpora-
tion therein of the following conditions of development:

Neither the property addressed by this segment
nor the adjacent 6-acre parcel may be developed
except pursuant to P.C.D. (Planned Commercial
Development) zoning. Applicant shall propose
said zoning.
Within 90 days of final approval of said Land
Use Element Amendment, the applicant, property
owner and/or developer will file a revised par-
cel map removing the existing lot lines to cre-
ate one 8.99-acre parcel.
Within one (1) year of final approval of said
Land Use Element Amendment, the applicant, pro-
petty owner and/or developer will record said
revised parcel map removing the existing lot
lines to create one, 8.99-acre parcel.

With approval of the Parcel Map as per
Condition "b" the applicant will contract and
bond for construction of curbs, gutters and
street paving to city standards on the north
half of Panama Lane between Summerfield Drive
and $tine Road, and on the east half of Stine
Road between Panama Lane and Maybrook Avenue.
Minimum 5.5' wide sidewalks will be required at
the time of development on all streets.

Th~ applicant shall post with the City Engineer
a bond payable to the city in the amount of
$25,000 to assure payment of 25 percent of the
cost of the installation of a traffic signal at
the intersection of Panama Lane and $tine Road
and shall make payment upon demand by the city
for construction of a traffic signal. (Traffic
Engineering)
5. That Segment II, approved herein, be combined with
other approved segments, described in separate resolutions, to
form a single Land Use Element Amendment, 2-86.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
regular meeting thereof held on the 30th day of July____,
