A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD REGARDING THE USE OF HOUSING SET
ASIDE MONIES OUTSIDE THE DOWNTOWN
REDEVELOPMENT PROJECT AREA.
WHEREAS, there is a need in the City of Bakersfield (the "City") for decent, safe
and sanitary housing and particularly for housing affordable to low-income and moderate-
income persons; and
WHEREAS, the Community Redevelopment Law of the State of California (Health
and Safety Code Section 33000 et. seq.), (the "Law"), imposes specific obligations on each
redevelopment agency to respond to housing needs within their jurisdiction, including, but
not limited to, establishment of a Low-and Moderate-Income Housing Fund (the "Fund");
and
WHEREAS, Section 33334.2 of the Law provides that the redevelopment agency
shall use not less than twenty percent (20%) of all taxes which are allocated to it for the
purposes of increasing, improving, and preserving the community's supply of low- and
moderate-income housing; and
WHEREAS, Section 33334.2 also provides that an agency may use these funds
inside or outside the Redevelopment Project Area upon a resolution of the agency and the
legislative body that such use of funds will be of benefit to the Redevelopment Project
Area; and
WHEREAS, land uses in the downtown Bakersfield Redevelopment Project Area
are not conducive to the construction of single-family units; and
WHEREAS, there has been virtually no growth in conventional housing in the
Redevelopment Project Area and the existing housing inventory is almost exclusively
occupied by low-income households; and
WHEREAS, a number of conditions limit the ability of the CDDA to provide
residential development in the Redevelopment Project Area, such as, the existing land
uses and socio-economic characteristics of the Redevelopment Project Area and the
relatively limited funds available from the Agency's Low-and Moderate-Income Housing
Fund compared to the cost of downtown housing development; and
WHEREAS, available land that is suitable for multi-family development is limited and
probable land acquisition costs indicate a need to provide significant levels of financial
assistance for the new construction of housing projects; and
WHEREAS, with plentiful land and an active residential development market,

outside of the Redevelopment Project Area, but within the limits of the City of Bakersfield,
Bakersfield offers some of the most affordable housing of any major metropolitan area in
the state of California; and
WHEREAS, the CDDA can provide more people affordable housing opportunities
by allowing the use of housing monies outside the Redevelopment Project Area; and
WHEREAS, in 1995, the City Council of the City of Bakersfield adopted the
Bakersfield Consolidated Plan 2000 ("the Plan"), a five-year strategic planning document
required by the United States Department of Housing and Urban Development ("HUD")
and;
WHEREAS, the Plan discussed the use of federal funds throughout the City; and
WHEREAS, the Home Investment Partnership Program ("HOME") is funded through
HUD; and
WHEREAS, the HOME Program was created to provide decent, affordable housing
to lower-income households, to expand capacity of nonprofit housing providers, to
strengthen the ability of state and local governments to provide affordable housing and to
leverage private sector participation in affordable housing production; and
WHEREAS, the City of Bakersfield has been an entitlement jurisdiction for the
HOME Program since 1993; and
WHEREAS, the City's HOME Program funds a variety of housing activities, such as:
building acquisition, First Time Homebuyer Mortgage Assistance, and rehabilitation of
multi-family residences.
WHEREAS, the HOME guidelines require that each jurisdiction contribute a twenty-
five percent (25%) non-federal match for every federal dollar expended; and
WHEREAS, to be considered an eligible match, a contribution must be made from
non-federal sources and must be a permanent contribution to a HOME Program; and
WHEREAS, the CDDA can provide funds from its Low- and Moderate-Income
Housing Fund as a match to the City's HOME Program allocation; and
WHEREAS, use of the housing set-aside funds constitute a grant to the City's
HOME Program to further low- and moderate-income housing in the City of Bakersfield;
and
WHEREAS, once said funds as described above have been loaned or granted by

the City any repayment of these funds shall be deposited solely into the City's HOME
Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD as follows:
1. The above recitals are true and correct;
The use of funds from the Low- and Moderate-Income Housing Fund outside
of the Redevelopment Project Area will benefit the Redevelopment Project
Area;
The City Council accepts $616,198 from the Agency's Low- and Moderate-
Income Housing Fund to be used as part of the required non-federal match
of funds under the HOME Program.
The City Council will designate the $616,198 from the Agency be placed in
the HOME Program and designate it be used for the City's First Time
Homebuyers Program.
