The meeting was called to order by Mayor Medders, followed by the Pledge of Allegiance. City Clerk Williams called the roll as follows: Present: Absent: Mayor Medders, None Councilmembers Anthony, Smith, DeMond, Ratt y, Peterson, McDermott, Salvaggio HEARINGS This is the time set for a public hearing before the Council for hearing protests by property owners on the amount of assessments or the fairness of the benefit formula to be borne by all parcels of property within Maintenance Districts 1 through 20, which provides the bases for the benefit assessments for maintaining certain local improvements within each District. This hearing has been duly advertised and the property' owners notified as required by law. Maintenance District No. 1: includes streetscapes along Stockdale Highway, Kroll Way, and Ming Avenue. This district Gosford Road, Camino Media, Correspondence has been received from Paul A. Kronenberg, 8216 Norfolk Court, in opposition to the assessment. Mayor Medders declared the hearing open for public participation. Paul Kronenberg, 821 6 Norfolk Court, spoke in. opposition to the assessment. Urged Council to direct staff tc. reduce the 1988-89 assessment by restoring Oceanic's allocation to 100% as it was the previous year and to seek alternatives to lessen the cost. George Haller, Land Administrator for Oceanic Communities, Inc., spoke in opposition to the assessment, stating there should be zero assessment on that property. Carl Woody, 8000 Lindy Way, member of the Association Board, spoke regarding the assessment. George Haller, Land Administrator for Oceanic Communities, Inc. , spoke in rebuttal in opposition to the assessment. No further protests or objections being received, and no one wishing to speak in favor, Mayor Medders closed the public portion of the hearing for Council deliberation and action. Councilmember Peterson made a motion to adopt Resolution approving budget, levying assessment, reserving the right to perform maintenance ~Drk by City forces and authorizing collection of assessments by Kern County Tax Collector. Upon an amended motion by Councilmember Peterson, the hearing was rescheduled to June 28th, 1989, and staff was directed to renotice the hearing. Correspondence has been received from James Metchikoff, 6608 Caswell Avenue; Lawrence F. Young, 1800 Vallecito Lane; and Irene Johnson, 4701 Calaveras Court, in opposition to the assessment. Mayor Medders declared the hearing open for public participation. No protests or objections being received, and no one wishing to speak in favor, Mayor Medders closed the public portion of the hearing for Council deliberation and action. Councilmember McDermott made a motion, for all the districts dealing with park maintenance, the City cover the cost of 25% of the park maintenance lowering the assessment to the homeowners in those districts. Upon a motion by Councilmember Peterson, Resolution No. 80-89 of the Council of the City of Bakersfield approving budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector was adopted by the following roll call vote: Ayes: Councilmembers Noes: None Abstain: None Absent: None Smith, Anthony, DeMond, Ratty, McDermott, Salvaggio Petersoh, Action of Maintenance District No. 2 was reconsidered on Page 3. Maintenance District No. 3: This district includes Campus Park north and Campus Park south; median landscaping and streetscapes along Old River Road, White Lane, Gosford Road, District Boulevard, Park View Drive, and Pin Oak Boulevard. Correspondence has been received from Chester Pohle, 101 Longwood Drive, Lafayette, Louisiana; and Henry J. Walker, 8809 Andrieu Court, in opposition to the assessment. Mayor Medders declared the hearing open for public participation. Robert Stempies, 8220 Sergeant Way, spoke in opposition to the assessment. He suggested a City-wide maintenance district for parks and street landscaping. Bakersfield, California, June 5, 1989 Page 3 to the area. Henry Walker, assessment, and 8809 Andrieu Court, spoke in opposition suggested a committee be formed for this Dan Crisp, 4400 LaBarge, spoke in opposition to the assessment. He urged Council to consider assessing utility companies in these areas for usage of right-of-ways. No further protests or objections being received, and no one wishing to speak in favor, Mayor Medders closed the public portion of the hearing for Council deliberation and action. Councilmember Ratty suggested staff contact interested persons regarding a committee for Maintenance District No. 3. Councilmember DeMond voiced concern about people not knowing about special maintenance districts when they move into an area. Suggested staff look into this issue. Adoption of Resolution No. 81-89 of the Council of the City of Bakersfield for Maintenance District No. 3 approving and adopting the 1989-90 Budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector. Upon a motion by Councilmember Ratty, Resolution No. 81-89 of the Council of the City of Bakersfield approving budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector was adopted by the following roll call vote: Ayes: Councilmembers Smith, Anthony, DeMond, Ratty, Peterson,. Mayor Medders declared the hearing open for public participation. Ed Schulz noted corrections to assessments to include a park in District No. 9. Also, when the assessment notices were mailed out, there were four lots incorrectly assessed at $20.37; they should have been $1.69. These corrections will be made on the final rolls. Mayor Medders declared the hearing open for public participation. Tony Telese, 2304 Kelso Peak Avenue, spoke in opposition to the assessment for Maintenance District No. 10. He also mentioned concerns regarding drainage and mosquitos. Councilmember Salvaggio requested staff contact Mr. Telese regarding concerns on drainage and mosquitos and to report back to him on the status. Ed Schulz commented that when the notices were sent out, the notice was sent out for approximately $87 for the park and street landscaping assessment. That was an error and the correct assessment is $56.10. Fred Evenson, 6013 Cedar Glen, President of Rancho Stine Homeowners' Association, spoke in opposition to the assessment on Maintenance District No. 14. Linda Thompson spoke in opposition to the assessment on Maintenance District No. 14. John Fachin, 3601 Panama Lane, spoke in opposition to the assessment on Maintenance District No. 14. He suggested Council review the need for a park and remove this Association from the tax assessment rolls for such park.
