A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT IV OF PROPOSED
AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLAN
(LAND USE AMENDMENT 4-85).
WHEREAS, the Council ot the City o~ Bakersfield referred
Segment IV of a proposed amendment to the Land Use Element o~ the
Bakersfield Metropolitan Area General Plan to the Planning
Commission; and
WHEREAS, the Planning Commission of the City o~
Bakerstleld, in accordance with the provisions o~ Section 65351
of the Government Code, held a public hearing on January 2, 1986,
on Segment IV of a proposed amendment to the Land Use Element of
the General Plan, notice of the time and place of hearing having
been given at least ten (10) calendar days before said hearing by
publication in the Bakersfield Californian, a local newspaper of
general circulation; and
WHEREAS, such Segment IV o~ the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan is as follows:
SEGMENT IV:
SIMPSON VAN CUREN, INC. has applied to amend
the General Plan Land Use Element designation
for ~our areas generally located in northeast
Bakersfield in the vicinity of the intersection
o~ Panorama Drive extension and Morning Drive
extension northerly of Auburn Street. The
first would change ~.24 acres from High Density
Residential to Low Density Residential. The
other three would change 5.45, 4.92 and '/.42
net acres from Low Density Residential to High
Density Residential.
WHEREAS, for the above-described Segment, an Initial
Study was conducted, and it was determined that, with mitigation
measures incorporated as conditions in the project and accepted
by the applicant, the proposed project would not have a signiti-
cant eftect on the environment, and a Negative Declaration was
prepared; and
WHEREAS, the law and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution No. 132-83 have been duly fol-
lowed by the City staff and the Planning Commission; and
WHEREAS, by Resolution No. 1-86 on January 2, 1986,
the Planning Commission recommended approval and adoption ot
Segment IV by this Council and this Council has fully considered
the ~indings made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the Council of the City o~ Bakersfield, in
accordance with the provisions o~ Section 65355 of the Government
Code, conducted and held a public hearing on March 5, 1986, on
the above-described Segment IV of the proposed amendment to the
Land Use Element o~ the Bakersfield Metropolitan Area General
Plan, notice of time and place o~ the hearing having been given
an least ten (10) calendar days before the hearing by publication
in the Bakersfield Calilornian, a local newspaper of general cir-
culation.
NOW, THEREFORE, BE IT RESOLVED and ~ound by the Council
o~ the City of Bakersfield as follows:
1. The above recitals and findings, incorporated
herein, and are found to be true and correct.
2. The Negative Declaration for Segment IV is hereby
approved and adopted.
3. The report of the Planning Commission, including
maps and all reports and papers relevant thereto, transmitted by
the Secretary of the Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The City Council hereby approves and adopts
Segment IV of the proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan, subject to the
following six (6) conditions included in the project with the
consent o~ the applicant:

(1)
Provide neighborhood parks tor residential
development consistent with the City Park and
Open Space policies as approved by the City
Bakerstield.
(2)
Single-family and multiple-family residences
shall be buffered from commercial uses as per
adopted City policies and ordinance require-
ments.
(3)
Single-~amily structures shall be separated
and protected trom two-story, multi-family
structures as per adopted City policies and
ordinance.
(4)
A comprehensive drainage plan shall be pro-
vided prior to any development or subdivision.
A portion of the site is in the Breckinridge
Planned Drainage Area.
(5)
Interim facilities consistent with the compre-
hensive drainage plan shall be provided to
include temporary on-site retention until
such time as permanent ~acilities are available.
(6)
The site is within the area o~ benefit of a
proposed sewer trunk line extension from
Brundage Lane, generally along the Morning
Drive alignment, and the site shall be
included in an assessment district for the
construction of those sewer lines and ~acili-
ties. This shall be noted on CC&R's and Final
Maps prepared for any development within the
area.
Because there is no sewer available with per-
manent capacity for development in this area,
sewer service will be available only on a tem-
porary basis for up to 40 acres of develop-
ment. Temporary service will be available tor
5 years. During that time, the assessment
district shall he formed and the trunk sewer
extended to the site.
5. That Segment IV o~ the proposed amendment to the
Land Use Element be combined with Segment VI thereo~, approved by
separate resolution, to constitute Land Use Element Amendment
4-85.
