HomeMy WebLinkAboutRES NO 28-86RESOLUTION NO. 28-86 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD INITIATING PROCEEDINGS FOR THE ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS PROCEEDING NO. 887, ANNEXATION NO. 306, IN ACCORDANCE WITH LAFCO RESOLUTION MAKING DETERMINATION (CASTRO NO. 4). WHEREAS, a proposal was submitted to the Local Agency Formation Commission of Kern County ("Commission") for the annex- ation of territory to the City of Bakersfield designated as Annexation No. 306 (CASTRO NO. 4); and WHEREAS, a duly noticed public hearing upon said pro- posal was held before the Commission on the 25th day of February, 1986, and continued to the 11th day of March, 1986; and WHEREAS, following said public hearing the Commission, on March 11, 1986, adopted its Resolution Making Determination, being Resolution No. 86-7, recorded in Minute Book 32 of said Commission. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Preliminary proceedings for annexation of to the City of Bakersfield designated as Annexation No. territory 306 (CASTRO NO. 4) were authorized by the City Council of the city of Bakersfield by action at a regular meeting thereof held on October 16, 1985, Application for Annexation dated October 24, 1985, was transmitted to LAFCO; the Certificate of Filing of the Executive Officer of the Commission shows that the proposal was filed by him on the 5th day of February, 1986. 2. The distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: "City of Bakersfield Annexation No. 306 (CASTRO NO. 4)." 3. The description of the exterior boundaries of the territory proposed to be annexed is contained in Exhibit "A", attached hereto, and incorporated in this Resolution as though fully set forth herein. 4. The territory proposed to be annexed is inhabited as determined by the Commission in its Resolution Making Determination. 5. The reasons for the proposed annexation as set forth in the proposal thereof submitted to the Commission are that the owners of the affected territory desire to receive, and in some instances already are receiving, municipal services from the City of Bakersfield and the City desires to receive tax revenues for to be given to the territory proposed to be benefits given and annexed. 6. BE IT FURTHER RESOLVED, that Wednesday, the 7th day of May, 1986, at the hour of 7 p.m. (or as soon thereafter as the matter may be heard) in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time, date and place of hearing on the proposed annexation where any owner of land within, or any registered voter residing within, the said described territory may appear before the Council of the City of Bakersfield and show cause why such territory should not be annexed. Any owner of land within, or any registered voter residing within, the described territory may file a written protest against the annexation with the City Clerk of the City of Bakersfield at time prior to the conclusion of the annexation. 1501 Truxtun Avenue at any hearing on the proposed 7. That the city of Bakersfield, as lead agency, has completed an environmental assessment and a Negative Declaration was adopted by the Planning Commission after a public hearing thereon and this Council hereby approves and adopts the Negative Declaration. The project will not have a significant effect on the environment. 8. The annexed shall be existing at the time land and improvements within the territory to be liable for the general indebtedness of the City of annexation. 2 the passed and adopted by the Council of regular meeting thereof held on the 1986, by the following vote: HEREBY CERTIFY that foregoing Resolution was the City of Bakersfield at a 2nd day of ADril , CITY CLERK and Ex Officio Clerk of the Council of the City of Bakersfield APPROVED this 2nd day of April , 1986 MAYOR of the City of Ba~ APPROVED as to form: - ~/~'~iof Bakersfield CI Y~ATT~N~of the C'ty bl 5 R.CAS4-IP 3 ANNEXATION NO. 306 CASTRO NO. 4 A parcel of land situated in the County of Kern, State of Callforn~a, being a portion of Sections 35 and 36, Township 29 South, Range 27 East ~nd Sections 1 and 2, Township 30 South, Range 27 East, more particularly described as follows: Beginning at the intersection of the west llne of the East (30) feet of said Section 2 with the westerly prolongation of the North line of Parcel Map No. 6617, recorded May 27, 1983, in Parcel Map Book 29 at page 131 in the Office of the Kern County recorder, said point being a point on the exlst~ng corporate boundary of the City of Bakersfield and the point of beginning for this description; Thence (1) departing from the last named existing corporate boundary northerly along the West line of the East (30) feet of said Section 2 and the West llne of the East (30) feet of said Section 35 to intersect with the North line of the South (60) feet of said Section 35, said point being a point on the existing corporate boundary. Thence (2) Northerly, Easterly, Southerly and Westerly along the last named corporate boundary to the point oF-beginning.
