A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT VI OF PROPOSED
AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLAN
(LAND USE AMENDMENT 4-85).

WHEREAS,
Segment VI of a proposed amendment to
Bakersfield Metropolitan Area General
Commission; and
WHEREAS, the Planning commission ot
the City of Bakersfield re~erred
the Land Use Element of the
Plan to the Planning
the City
Bakersfield, in accordance with the provisions ot Section 65351
of the Government Code, held a public hearing on December 19, 1986,
on Segment VI ot a proposed amendment to the Land Use Element of
the General Plan, notice of the time and place of hearing having
been given at least ten (10) calendar days betore said hearing by
publication in the Bakersfield Californian, a local newspaper o~
general circulation; and
WHEREAS, such Segment VI of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan is as tollows:
SEGMENT VI:
THE CITY OF BAKERSFIELD has applied to amend
the General Plan Land Use Element, Rio Bravo
Land Use and Transportation Element designation
from Open Space, Low Density Residential and
commercial to Open Space on approximately 318
acres, generally located in northeast Bakersfield
(the China Grade Landfill 1,200-foot Butter Zone)
east of Alfred Harrell Highway.
WHEREAS, for the above-described Segment, an Initial
study was conducted, and it was determined that, with mitigation
measures incorporated as conditions in the project and accepted
by the applicant, the proposed project would not have a signifi-
cant ettect on the environment, and a Negative Declaration was
prepared; and
WHEREAS, the law and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution No. 132-83 have been duly fol-
lowed by the City state and the Planning Commission; and
WHEREAS, Dy Resolution No. 160-85 on December 19, 1985,
the Planning Commission recommended approval and adoption ot
Segment VI by this Council and this Council has gully considered
the ~indings made by the Planning Commission as set torth in that
Resolution; and
WHEREAS, the Council ot the City of Bakersfield, in
accordance with the provisions ot Section 65355 o~ the Government
Code, conducted and held a public hearing on March 5, 19~6, on
the above-described Segment VI of the proposed amendment to the
Land Use Element o~ the Bakersfield Metropolitan Area General
Plan, notice o~ time and place of the hearing having been given
an least ten (10) calendar days begore the hearing by publication
in the Bakersfield Californian, a local newspaper of general cir-
culation.
NOW, THEREFORE, BE IT RESOLVED and found by the Council
ot the City o~ Bakersfield as follows:
1. The aDove recitals and findings, and tindings num-
bers 2. through 9. set torth in Planning Commission Resolution
No. 16U-85, are hereby incorporated herein, and are found to be
true and correct.
2. The Negative Declaration ~or Segment VI is hereby
approved and adopted.
3. The report of the Planning Commission, including
maps and all reports and papers relevant thereto, transmitted by
the Secretary ot the Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The City Council hereby approves and adopts
Segment VI of the proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan.
5. That Segment VI of the proposed amendment to the
Land Use Element be combined with Segment IV thereof, approved by
separate resolution, to constitute Land Use Element Amendment
4-85.
