HomeMy WebLinkAboutRES NO 35-86RESOLUTION NO. 35-86 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE UNUSED PORTION OF THE OAK STREET RIGHT-OF-WAY LYING BETWEEN 16TH STREET AND THE A.T.&S.F. RAILROAD RIGhT-OF-WAY IN THE CITY OF BAKERSFIELD. WHEREAS, on the 5th day of March, 1986, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law", being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1001 declaring its intention to order the vacation of the unused portion of the Oak Street right-of-way lying between 16th Street and the A.T.&S.F. Railroad right-of-way in the City of Bakersfield, California; and WHEREAS, said Council did fix a time and place for hear- ing all persons interested in or objecting to said proposed vaca- tion, which said hearing was held on the 16th day of April, 1986, after notices were duly published and posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That the unused portion of the Oak Street right-of-way lying between 16th Street and the A.T.&S.F. Railroad right-of-way in the City of Bakersfield, County of Kern, State of California, more partic- ularly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for present or prospective public street purposes. 2. That the unused portion of the Oak Street right-of- way lying between 16th Street and the A.T.&S.F. Railroad right- of-way be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with any reservations and exceptions contained in and contemplated by said Resolution of Intention No. 1001. Reference contemplated by said Resolution of Intention is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. .......... o0o .......... HEREBY CERTIFY that the foregoing I passed and adopted by the Council of the City of regular meeting thereof held on the 16th day of 1986, by the following vote: Resolution was Bakersfield at a April , CITY CLERK and Ex Officio Clerk of the Council of the City of Bakersfield APPROVED this 16th day of April , 1986 MAYOR of the City of Bakersfield APPROVED as to form: CItY ATTORNEY of~'~he C'ty of Bakersfield bl 5 RI1001-O 2 EXItI BIT "A" OAK STREET SURPLUS P'ROPERTY A parcel of land situated in the West 1/2 of the Southwest 1/4 of Section 25, Township 29 South, Range 27 East, M.D.M., City of Bakersfield, County of Kern, State of California more particularly described as follows: Commencing at the Southwest corner of Block 417-C, also being a point on the East right of way line of Oak Street as conveyed 'to the State of California by Deed recorded June 3, 1939, in Book 872, Page 62 in the Office of the Kern County Recorder, (subsequently relinquished to the City of Bakersfield); Thence North 00°51'10" West along said right of way llne 97.40 feet to the beginning of a 25.00 foot radius curve concave to the southeast, said point being the True Point of Beginning for this description: Thence (1) Northeasterly along said curve and right of way line through a cen- tral angle of 89°06'20" an arc distance of 38.88 feet; Thence (2) North 03°06'20" East along said right of way line a distance of 20.03 feet to the beginning of a 25.00 foot radius curve concave to the Northeast whose radial bears North 00'02'30" West; Thence (3) Northwesterly along said curve and right of way llne through a cen- tral angle of 90°53'40" an arc distance of 39.66 feet; Thence (4)Departing said right of way line, South 00°51'10" West a distance of 70.01 feet to the True Point of Beginning. Containing 768.22 Square Feet
