Re: Failure to Update Business Plan Showing Change in Name
And Ownership, Failure to Properly Identify Tank Farms
NOTICE OF VIOLATION AND SCHEDULE FOR COMPLIANCE
Dear Mr. Batch:
During my annual inspection it was noted that you have changed the name of
your company. It is also noted that you have not made a change in your business
plan on file to reflect the change. You are in violation of Section 25503.5 and
25509 of the California Health & Safety Code. For your convenience I am
enclosing a business plan form, please make the changes and send it to my
attention.
In addition, you are in violation of Section 7904.3.6 of the California Fire Code
(2001 Edition).
"Storage of flammable or combustible liquids in tank(s) shall be in
accordance with Section 7902. Each oil tank or group of tanks shall have
posted in a conspicuous place on or near such tank or tanks an approved
sign with the name of the owner or operator, name or number of lease and
the telephone number where a responsible person can be reached at any
time."
No such signs were found on your tank farms. It is also noted that your oil well
signs although readable don't conform to code as far as a proper sign.
Therefore, you have 30 days (April 25, 2004) to correct these violations. Failure
to comply will result in further enforcement actions.
