RE: Certification of Financial Responsibility - Underground Storage Tanks
Dear Ralph,
Please find attached a certification indicating that the aggregate limit per tank as required
by those entities with more than 100 tanks is in fact 2 million dollars as specified in
Chapter 18.
CHAPTER 18 (COMMENCING WITH SECTION 2803), DIVISION 3, TITLE 23,
CALIFORNIA CODE OF REGULATIONS
2807. Required Financial Responsibility Amounts2807
(a) Owners or operators must demonstrate financial responsibility in
the amounts required by the Federal Act. Currently the federally
required minimum amounts are: 2807(a)
(1) $1 million per occurrence for owners and operators of
underground storage tanks either located at a petroleum marketing
facility or which handle an average of more than 10,000 gallons of
petroleum per month based on annual throughput for the previous
calendar year; or) (1
(2) $500,000 per occurrence for all owners or operators not
included in the preceding subdivision; and
(3) $1 million annual aggregate coverage for owners or operators
of 1 to 100 underground storage tanks; or
(4) $2 million annual aggregate coverage for owners or operators
of 101 or more underground storage tanks.
(b) The amounts of assurance required under this section exclude legal
defense cost as defined in 40 Code of Federal Regulations, section
280.92.2807 (b) .
The amount originally indicated was erroneously listed as 1 million. Updated letters will
be issued to those CUP As who received the misstated letter notifying them that in fact
SBC is in compliance with the provisions of Chapter 18. The mechanism type remains a
certificate of insurance with policy number 409-1 USTOO 1 as issued by Gateway Rivers
Insurance Company of St. Paul, Minnesota covering the period of 12/31/03 - 12/31/04.

It is hereby understood and agreed that effective June 1, 2004 the aggregate limit of coverage
under this policy is increased from $1,000,000 to $2,000,000.
The Annual Tank Premium will be increased from $750 to $1000 per tank.
All other terms, clauses and conditions remain unchanged at this time.
