Soils Engineering, Inc. (SEI) has prepared this Addendum #1 to a Phase 1 Environmental Site
Assessment Report dated June 4, 2004 for the subject site. The initial report did not include
research i1Úormation from the Bakersfield Fire Department Prevention Services (BFDPS)
regarding the subject site and other properties within I-mile of the site.
On October 18, 2004, SEl contacted Howard Wines with the BFDPS to obtain environmental
status information tor properties within I-mile of the subj eet site that are in the City of
Bakersfield. The review of the EDR database search and the BFDPS records indicates that the
following off-site environmental concerns are present within l-míle ot"the site and are in the City
of BakersfieJd limits.
Lehr Brothers Inc., Panama Lane - Listed as Historic underground storage tank (UST)
site. No other information available.
SO Mini-Mart., 6501 S. Union Ave. - Listed on UST database. Active UST site with new
instaJlation. No current environmental problems.
Beacon Liquor!:;, 6495 S, Union Ave, - Active underground storage tank site. The UST's
have been lined and this site has no current environmental problems.
Fairview Property, Fairview Rd. & Union Ave. - Former leaking underground storage
tank (LUST) site. Case was closed 5/91 and involved soil only.
Kern Valley Packing, 7100 H St. - Former LUST site which was closed in 8/90 and
involved soil only.

Based on this information nOne of these oft'-site properties within the City of Bakersfield appear
to be an environmental threat to the subject site.
The following are the conclusions and recommendations for the site.
o A few properties were reported to have leaks or store hazardous materials within a one-
mile radius of the site. The review of the Kern County Environmental Health Services
and the Bakersfield Fire Department Office of Prevention Services records indicates that
these off-site environmental concerns are not currently a threat to the subject property.
No cleanup activities are currently taking place or are required at these locations.
o Many years (50+) of agricultural activity have been conducted on the site, This has
included the application of pesticides. herbicides and associated metals, which may be
present in near surface soils at residual concentrations of concern. The site appears to
have been idle over the last few years. Multiple soil samples (12) were collected at the
neighboring property to the west (Valle Verde Elementary School) which was fanned by
the same operators. The analytical results of these soil samples appear to show no
significant concentrations of pesticides, paraquat or metals are present in near surface
soil. It is likely that this site would have similar results. These agricultural activities are
considered a minor recognized environmental concern (REC) to the property.
o No other signiíìcant recognized environmental concerns (REC's) were identified at this
site.
Recommendations
o Based on the analytical results of shallow soil samples on the neighboring property to the
west it appears unlikely that the site would be impacted with significant concenttations of
pesticide$ Or metals.
o Iftransite irrigation piping containing asbestos is Wlcovered during grading activities it
should be removed and properly disposed of per local. State and Federal regulations.
No current activities were found within a one-mile radius of the site which process) stOre or
transpon hazardous materials in sufficient quantity or in a mode which might have measurable
effect on the environmental integrity of the subject site. A few sites were found in our search of
available or "reasonably ascertainable" State or Federal government records within the ASTM E-
1527-00 search radius around the subject property for the databases shown in the Tables on pages
ES-1 to ES-5 (Appendix A). None of these sites have current environmental problems that may
affect the site as reported by the Kern County Environmental Services Department or the
Bakersfield Fire Department Prevention Services.

A Phase 1 ESA comprises a number of individual elements whose basic nature and extent are
detennined in accordance with the standard of Care applicable to Phase I ESAs. The standard of
care is conunonly defined as the care applied by the ordinary practitioner at the time and in the
area where the ESA was pertòrmed. We believe that we have comp1ied with the applicable
standard of care and that we have complied as well with Phase I ESA practices and service scope
elements recoIIlII1ended by the American Society for Testing and Materials (ASTM).
The accompanying repon is an instrument of service of Soils Englneeringþ Inc. The report
summarizes Our findings and relates our opinions with respect to the potential for hazardous
materials to exist at the site at levels likely to warrant mitigation pursuant to CUITent guidelines
regulated by the California EPA and California Water Quality Control Board and defined in
Titles 22 and 23 of CCR in the state of CaJifomia. Note that OUr findings and opinions are based
on infonnation that we obtained on given dates, through records review, site review. and related
activities. It is possible that other information exists Or subsequently has become known, just as
it is possible for conditions we observed to have changed after our observation. For these and
associated reason, Soils Engineering, Inc. and many of its peers routinely advise clients for ESA
services that it would be a mistake to place unmerited faith in findings and opinions conveyed via
ESA reports. Soils Engineering, Inc. carmot under any circumstances warrant or guarantee that
not fmding indicators of hazardous materials means that hazardous materials do not exist on the
site. Additional research, including invasive testing, can reduce the risks to you, but no
techniques now commonly employed can eliminate these risks altogether. Soils Engineering,
Inc. will be pleased to provide more information in this regard.

Based upon the information provided, this department has determined that
appropriate response actions have been completed, that acceptable remediation practices were
implemented, and that, at this time, no further investigation, remedial or removal action or
monitoring is required at the above stated address.
Nothing in this detennination shall constitute or be construed as a satisfaction or
release from liability for any conditions or claims arising as a result of past, current, or future
operations at this location. Nothing in this determination is intended or shall be construed to
limit the rights of any parties with respect to claims arising out of or relating to deposit or
disposal at any other location of substances removed from the site. Nothing in this
determination is intended or shall be construed to limit or preclude the Regional Water
Quality Control Board or any other agency from taking any further enforcement actions.
This letter does not relieve the property owner of any responsibilities mandated under
the California Health and Safety Code and California Water Code if existing, additional, or
previously unidentified contamination at the site causes or threatens to cause pollution or

This is to inform you that this department has reviewed the disposal documentation
and EP A ill profile associated with the contaminated soil removal.
Based upon the information provided, this department has determined that
appropriate response actions have been completed, that acceptable remediation practices were
implemented, and that, at this time, no further investigation, remedial or removal action or
monitoring is required at the above stated address.
Nothing in this determination shall constitute or be construed as a satisfaction or
release from liability for any conditions or claims arising as a result of past, current, or future
operations at this location. Nothing in this determination is intended or shall be construed to
limit the rights of any parties with respect to claims arising out of or relating to deposit or
disposal at any other location of substances removed from the site. Nothing in this
determination is intended 'or shall be construed to limit or preclude the Regional Water
Quality Control Board or any other agency from taking any further enforcement actions.
This letter does not relieve the property owner of any responsibilities mandated under
the California Health and Safety Code and California Water Code if existing, additional, or
previously unidentified contamination at the site causes or threatens to cause pollution or
nuisance or is found to pose a threat to public health or water quality,
