RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO SPECIAl, ASSESSMENT AND ASSESSMENT
BOND ACTS FOR THE ACQUISITION
OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER
DIVISION 4 OF THE STREETS AND HIGHWAYS CODE
CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 86-2
WHEREAS, all of the owners of more than 60% in area of
the property subject to assessment therefor have signed and filed
with the City Clerk of the City of Bakersfield a written petition
for undertaking proceedings pursuant to special assessment and
assessment bond acts, and to assess the costs thereof upon the
properties benefited by said improvements, and waiving proceedings
under Division 4 of the Streets and Highways Code, for the acqui-
sitions set forth in Exhibit "A" attached hereto and by reference
incorporated herein: and
WHEREAS, the costs and expenses of said contemplated
acquisitions are to be chargeable upon an assessment district, the

EXHIBIT "A"
GENERAL DESCRIPTION OF IMPROVEMENTS
ELIGIBLE FOR ACQUISITION PURSUANT TO CITY OF
BAKERFIELD ASSESSMENT DISTRICT NO. 86-2 PROCEEDINGS
(BUENA VISTA TRUNKLINE SEWER SYSTEM AND STAGE 1-A RANCHO LABORDE)
(PUBLIC IMPROVEMENTS)
The following descriptions of the improvements and the termini of the work
proposed for acquisition pursuant to City of Bakersfield Assessment District No.
86-2, hereinafter referred to as "AD 86-2", are general in nature. All items of
work do not necessarily extend for the full length of the description thereof.
The plans and profiles of the work and improvements to be acquired, as finally
approved by the Engineer of Work for AD 86-2, hereinafetr the "ENGINEER", shall be
controlling as to the correct and detailed description thereof. ~he work and
improvements 7o be acquired pursuant to AD 86-2 proceedings are generally
described as follows:
The acquisition by the City of Bakersfield, hereinafter referred to as the
"CITY", of certain sanitary sewage pipeline improvements and appurtenant
facilities generally referred to as the Buena Vista Trunkline Sewer System and
hereinafter referred to as the "TRUNKLINE", and of certain arterial street
improvements for the benefit of the Rancho Laborde Specific Planned Community,
hereinafter referred to as the "STAGE 1-A IMPROVEMENTS". The TRUNKLINE and
STAGE t-A IMPROVEMENTS are to be constructed by Laborde Cowunity Development
Company, Inc., hereinafter referred to as the "COMPANY", pursuant to the terms
and conditions of the CITY AGREEMENT for R~CHO LABORDE DEVELOPMENT, and the
AGREEMENT FOR THE ACQUISITION OF CERTAIN PUBLIC IMPRO%~MENTS - BUENA VISTA
SEWER PROJECT TRUNKLINE (RANCHO LABORDE), being CITY AGREEMENT NO. 86-45.
TRUNKLINE improvements eligible for acquisition include sanitary sewer
pipeline improvements complete with manholes, fittings and appurtenances and
all incidental work and equipment as needed to complete the installation of
said TRUNKLINE improvements in the following described locations:
In easements located generally along the East-West Quarter Line of
Section 18, Township 30 South, Range 27 East, Mount Diablo Base and
Meridian (MDB&M), from the point of connection with the existing westerly
terminus of CITY's Stockdale Trunkline Sewer System, westerly along said
easements to the intersection with the North-South Quarter Line of said
Section 18.
B. Northerly in easements located generally along said North-South Quarter
Line to the intersection with the Fraser Road right-of-way.
C. Westerly in and along said Fraser Road right-of-way to the Buena Vista
Road right-of-way.
Northerly in and along said Buena Vista
parallel to the West Line of said Township
with the Stockdale Highway right-of-way.

Continuing northerly in a pipeline easement running parallel with said
Township and Range West Line and parallel with the West Line of Township
29 South in said Range, MDB&M, to the intersection of the Brimhall Road
and Jewetta Avenue rights-of-way.

In the Brimhall Road right-of-way from last said intersection, easterly 2
miles, more or less, to the intersection with Coffee Road right-of-way
and continuing easterly from the east right-of-way line for Coffee Road
in an easement running along the South Line of Section 28 in last said
Township and Range, to the west right-of-way line for the Friant-Kern
Canal.
Northerly in a pipeline easement running along the North-South Quarter
Line of Section 29 in last said Township and Range to the intersection
with the South Line of Section 20 in last said Township and Range, said
Section 20 South Line also being in the right-of-way of the Rosedale
Highway. (State Route V1-KER-58).
Continuing northerly in and across said Rosedale Highway right-of-waM and
along a 110 foot wide roadway and utility easement generally known as
proposed Rancho Laborde Drive and shown on Parcel Map No. 6521, recorded
on September 15, 1983, in Book 30 of Parcel Maps at Page 6, Official
Records of Kern County, to proposed Hageman Road right-of-way as shown on
said Parcel Map 6521.
Easterly in proposed Hageman Road right-of-way as shown on said Parcel
Map across the Calloway and Friant-Kern Canal rights-of-way and along the
proposed easterly extension of said Hageman Road right-of-way across
Section 17 in last said Township and Range to the intersection of the
proposed Hageman Road right-of-way with the proposed right-of-way for the
southerly extension of existing Coffee Road along the East Line of said
Section 17.
Northerly in said Section 17 in a proposed new street right-of-way
(Creekside Road), from the point of intersection of said right-of-way with
said proposed Hageman Road right-of-way to the point of intersection of
said new right-of-way with the existing right-of-way for Olive Drive along
the North Line of said section.
STAGE 1-A IMPROVEMENTS eligible for acquisition include the following
described surface and underground improvements within the limits of the right
of way for those specific sections of arterial streets to be improved pursuant
to said Agreement for Rancho Laborde Development.
A. Scope of STAGE 1-A IMPROVEMENTS Eligible for Acquisition:
Arterial Street Surface Improvements, including right of way clearing
and removal of obstructions, relocation of existing electric
transmission line towers by Pacific Gas and Electric Company to ~ites
outside the planned street right of way; street grading and subgrade
preparation; asphalt concrete paving; construction of street medians,
where required, complete with concrete curbs and gutters, landscaping
and irrigation facilities; concrete curbs, gutters and sidewalks along
improved street sections; perimeter walls running along designated
sections of street right of way, complete with landscaping and
irrigation facilities; and street lighting.

Underground Improvements within the designated street right of way
sections, including sanitary and storm drainage sewer pipelines and
appurtenances, water mains and appurtenances, public utility conduits,
facilities and appurtenances.
B. Locations and General Descriptions: STAGE 1-A IMPROVEMENTS:
a. Olive Drive from Coffee Road to proposed Creekside Road: reconstruct
to full development street width;

Proposed Hageman Road from existing Fruitvale Avenue to proposed
Creekside Road: construct street to full development width, including
walls along right of way;
Proposed Hageman Road from proposed
Canal: construct median and roadway
width;
Creekside Road to Friant-Kern
to half the ultimate development
Proposed Coffee Road extension from existing terminus of Coffee Road
approximately one-half mile south of Olive Drive to the intersection
with proposed Hageman Road: construct median and roadway to half the
ultimate development width;
Proposed Coffee Road extension from proposed Hageman Road
intersection, south to Rosedale Highway: construct median and roadway
to full development width; scope of work excludes construction of a
bridge across Calloway and Friant-Kern Canals, where said bridge is
to be constructed by CITY;

Proposed Patton Way from proposed Hageman Road intersection to
existing Krebs Road: construct street to half the ultimate
development width;

Existing Fruitvale Avenue from Krebs Road northerly approximately
one-half mile: reconstruct Fruitvale west half to its ultimate
development width; no median.
The TRUNKLINE and STAGE i-A IMPROVEMENTS eligible for acquisition shall be
constructed by licensed California contractors under contracts awarded by
COMPANY to the lowest responsible bidder for the scope of work offered for
construction.
CITY shall aoquire the TRUNKLINE and Stage 1-A from COMPANY at the value
established for the Total Project Cost, which shall include that portion of
the actual contract price for construction of the eligible improvements as
prior approved by the CITY Engineer and paid to contractors by COMPANY, and
also including allowances for cost increases and decreases resulting from
contract changes determined in writing to be reasonable by the CITY Engineer
in his sole judgment. Additional costs eligible for assessment aquisition
financing as part of the Total Project Cost shall include labor and
transportation costs incurred by COMPANY for the purchase and delivery of
materials and equipment to be installed by COMPANY employed contractors and to
become a part of the completed improvements; interest on funds advanced by
COMPANY for engineering and construction work on TRUNKLINE and STAGE 1-A

IMPROVEMENTS, including the cost of design engineering services provided by
CITY and engineering consultants retained by CITY and COMPANY; soils analysis
and compaction testing during construction; the cost of on-site inspection of
pipe manufacturing operations by CITY and COMPANY; construction management and
contract administration engineering services; on-site observation of TRUNKLINE
and Stage 1-A improvements construction work by CITY and COMPANY; computer
analysis costs for design of the improvements and for construction contract
scheduling; design and construction control surveys and staking; aerial
photogrmmmetric controls and mapping costs; a~sessment engineering consultant
fees and expenses; bond counsel and special counsel fees and expenses;
assessment district formation expenses; bond issuance and sales costs
including reasonable allowances for financial consultant services, bond
registration, transfer and paying agent expenses; the estimated cost of
preparing, printing, servicing and collecting the improvement bonds proposed
to be issued; a bond issue reserve fund; CITY assessment district
administration charges and other charges associated with the doing of all
incidental work and payment of expenses therefor, as necessary to accomplish
any of the< foregoing work which may be necessary to complete the same in
accordance with the requirements of the CITY, the COUNTY of Kern, any agency
of the State of California or of the United States of America, any special
district of local government, or any regulated public utility company.
The acquisition of easements, including construction easements, or capacity
rights necessary by reason of the foregoing described work.
