ROLL CALL Present: Commissioners Gay, Ellison, Lomas, Spencer Absent: Commissioner Blockley, Tkac, Tragish Advisory Members: Robert Sherfy, Marc Gauthier, Phil Burns Staff: Marc Gauthier, Jim Movius, Pam Townsend 2. CONSENT CALENDAR: 4.1 Non-Public Hearing Items - None 4.2 Public Hearing Items 4.2a&b Approve continuance to March 17, 2004 of General Plan Amendment/Zone Change 03-1345 (Max P Bacerra and Associates) (Ward 4) Staff report given. Commissioner Lomas requested clarification on the net 5 acres. Staff clarified. Commissioner Gay suggested that it might be helpful to view the surrounding area for approximately 1 mile to see what other commercial uses are in the neighborhood. He further indicated that as an example for Ms. Lomas the Truxtun Extension Coffee Rd. (Fountain Plaza) is probably a 3—5 acre site. 5. PUBLIC HEARINGS — GENERAL PLAN AMENDMENTS / Land Use Element Amendments / Zone Changes: The following items will be heard on Thursday, December 9, 2004 Minutes, PC, December 6, 2004 Page 2 5.1a&b) General Plan Amendment/Zone Change 03-1345 (Max P Bacerra and Associates) (Ward 4) See Consent Agenda 5.2a&b) General Plan Amendment 04-0815 (Porter-Robertson Eng.) (Ward 4) Staff report given. Commissioner Gay inquired if there is precedent that would require a buffer between 2 'h acre lots where there are going to be animals with LR zoning? Staff indicated that the Commission will decide. Commissioner Lomas inquired if Staff has received phone calls to which Staff replied in the affirmative. Commissioner Lomas inquired about project access site via Snow Road near Allen Road to which Staff responded that access will primarily be through Snow Road and Allen Road would be a mistake. 5.3a&b) General Plan Amendment/Zone Change 04-0847 (Porter-Robertson Eng.) (Ward 4) Staff report given. Commissioner Lomas asked if there is sidewalk. The response was there is curb and gutter but no sidewalk. Commissioner Gay confirmed that if it is zoned C-O that they could not change to C-1 or C-2 without coming back before the Commission. Commissioner Ellison indicated that he does not want this item on the Consent Calendar. 5.4a&b) General Plan Amendment/Zone Change 04-0867 (Porter-Robertson Eng.) (Ward 7) Staff report given. Commissioner Spencer asked why this item is not been put on the Consent Calendar for Thursday? Staff indicated that he will aggressively address this issue before Thursday's meeting. Commissioner Ellison requested a refresher on the geometrics, and Staff provided same. Commissioner Lomas inquired about there being only one point of access to which Staff responded that there will be one access and then other drives inside the development. Minutes, PC, December 6, 2004 Page 3 Commissioner Lomas further inquired about the indicated 4 acre park site with the requested 2 acres park site, and Staff responded they would have clarification for Thursday's meeting. Commissioner Gay commented that his question is whether you increase the zoning, increase the traffic in a tough situation where right of ways will be purchased based on C-2, and how much is really added with one driveway approach so close to an off-ramp? Commissioner Lomas stated that she would like to better understand what should be done with that property. Staff indicated that they will have more information for Thursday's meeting. Commissioner Ellison asked if a traffic study was done, to which Staff responded in the negative as they discovered that the change from what's on the General Plan and now and what is being proposed is a push. Commissioner Ellison stated that he would like this item pulled from the Consent Calendar. 5.5a&b) General Plan Amendment/Zone Change 04-1322 (Susan & George Lucas) (Ward 7) Staff report given. It was stated in the Bakersfield Californian that "Head, Hide and Hoof "were found, and therefore it was conditioned with a 10 foot soil sample. Commissioner Lomas inquired what the park mitigation is and Staff responded they would have that information for Thursday's meeting. Commissioner Lomas further inquired about why a soil study is not being required from this applicant, to which Staff responded that prior to any building construction there would be a soil study required. Commissioner Gay commented that Phase 1 sampling may be a lesser requirement then the soil sampling, as the Phase 1 will only be a paper analysis. 5.6a&b) General Plan Amendment/Zone Change 04-1326 (Porter-Robertson Eng.) (Ward 7) Staff report given. Commissioner Ellison asked if a PUD would be of any benefit? Commissioner Lomas inquired if Staff responded to the letter from Denita Nobel, to which Staff responded they do not recall, and Staff indicated they will follow up on this. Commissioner Spencer inquired if the Commission went along with the proposal as recommended by the applicant to R-1 if it would appease the letter writers, to which Staff suggested this be brought up at the public meeting. Commissioner Lomas stated that she would like to see Ms. Nobel's letter addressed, and indicated that she does not want to see R-1. She indicated that she would like to look at a PUD that would help the neighbor's concerns. 5.7a&b) General Plan Amendment/Zone Change 04-1328 (Jim Childress) (Ward 1) Staff report given. Due to a malfunction in the recording, there are no minutes for this Minutes, PC, December 6, 2004 Page 4 item. 5.8a,b&c) General Plan Amendment/Zone Change/Cancellation of Williamson Act Contract 04-1334 (Lusich) (Ward 5) Staff report given. This item has been requested to be put on the Consent Calendar. Commissioner Lomas asked for clarification on item numbers 3 and 7, regarding normal full frontage improvement shall be required at the time of development, and the developer shall pay median fees for the frontage of the property, and if this applies to Panama and Old River or both? Staff indicated they will provide the answer at Thursday's meeting. She further asked that if a requested condition is changed if it can stay on the Consent Calendar to which Staff responded that it can stay on consent as long as the applicant and City agree. Commissioner Spencer stated he has no problem with the conversion. 6. PUBLIC HEARINGS — GENERAL PLAN AMENDMENTS / Land Use Element Amendments / Zone Changes: The following items will be heard on Thursday, December 16, 2004 6.1) General Plan Amendment 04-0838 (City of Bakersfield) (Ward 1) Staff report given. No Commissioner comments. 6.2a&b) General Plan Amendment/Zone Change 03-0340 (Pinnacle Eng.) (Ward 3) Staff report given. Commissioner Lomas inquired if the solid exterior doors are a part of Code, to which Staff responded that in a residential you could have a hollow exterior door depending on the energy rating, but wouldn't necessarily be Code for safety, etc. The required wall for noise is a policy issue. Commissioner Gay asked if Staff has a mitigation measure that will require open channels or pipe and if there will be some consistency to this, to which Staff responded they have not required only pipe at this point. Commissioner Ellison inquired if Staff could explain how this project ties in with the existing tract maps for Thursday's meeting. 6.3a&b) General Plan Amendment/Zone Change 03-0746 (McIntosh & Associates) (Ward 3) Staff report given. Minutes, PC, December 6, 2004 Page 5 Commissioner Lomas inquired if Masterson is all the way through as an arterial, to which Staff responded that it shows the existing right-of-way of what has and has not been dedicated. Commissioner Spencer inquired if the street names have been clarified as far as being Vineland Road or Queen Street, to which Staff responded that Vineland is going to be the name of the street and not Queen, so that anything south of Paladino is Vineland. 6.4a&b) General Plan Amendment 04-0814 (Porter-Robertson Eng.) (Ward 4) Commissioner Ellison inquired about the cut-out piece that is a remnant that will remain RR, and what the nature of that piece is currently, to which Staff responded that it is a single lot, single family dwelling. Commissioner Ellison stated that he is in favor of pulling it off of Consent. Commissioner Lomas indicated that she wants to make sure on the one that will be discussed on Thursday that there be information available for discussion about doing the project to the north. Commissioner Ellison pulled this item off of the Consent Calendar. 6.5a&b) General Plan Amendment/Zone Change 04-1336 (Porter-Robertson Eng.) (Ward 4) Staff report given. No opposition has been received. Commissioner Lomas asked what B is in the noise mitigation, to which Staff responded that Condition #1 is Exhibit A-2 for a 12' sound wall. Staff will clean up the reference to B and C for Thursday's meeting. This will remain on the Consent Agenda. 6.6a&b) General Plan Amendment/Zone Change 04-1337 (SmithTech USA) (Ward 1 upon annexation) Staff indicated this project has a lot of problems. Staff indicated there are four airport zones. Commissioner Lomas indicated that she is looking for discussion regarding the canal. 6.7a&b) General Plan Amendment/Zone Change 04-1340 (San Joaquin Engineering Inc.) (Ward 4) Staff reported given. There is considerable opposition about the multi-family, but not a lot of concerns raised about the residential. Commissioner Ellison stated the Commission is in receipt of petitions and letters from the neighbors. Commissioner Gay suggested that it might be useful to have the Conditions placed on Meany and Patton on the apartment complex for Probuilt where there is a power line easement street landscape requirement. He stated that on the M zoning his issue would be setbacks and landscaping if the straight M zoning would give them enough curb Minutes, PC, December 6, 2004 Page 6 appeal, landscape berm or setbacks, or if they go to a PCD to get the nicer landscape area. He indicated that he would like to buffer Rosedale Highway with something better than the minimum. Staff confirmed that Commissioner Gay is requesting an aerial of the electrical lines, and get the Conditions used to separate other apartment complexes to get a 10 or 15 foot landscape area so they can get the control along Rosedale Highway. Commissioner Lomas indicated that she is looking for more information as to what is mobile home and what is existing and what is coming. She also requested how many units are proposed for new proposals? Commissioner Spencer inquired if Staff would consider adding PD (Precise Development Plan) to the M-1 zone, to which Commissioner Ellison responded that placing on a PCD overlay would be at the Commission's discretion at this point. 6.8a&b) General Plan Amendment/Zone Change 04-1343 (Maurice Etchechury) (Ward 4) Staff report given. Commissioner Lomas inquired where the dividing line is where Allen Rd. goes from collector to arterial, to which Staff responded that south of Hageman is an arterial, and north of Hageman a collector. Commissioner Lomas inquired if Staff would look into why this situation is the way it is. Commissioner Gay commented that the development is being built to collector status already. Commissioner Gay inquired if Staff is comfortable that there will be only curb/gutter, to which staff responded that if they don't ask for anything more then they don't see that anything more should be required of them. Staff stated that if there should be additional permits, such as the frontage on Snow and Allen, then it would be appropriate. Commissioner Gay cautioned that Staff think ahead, and that he would have no problems with changing the zoning to M-2. Mr. Ellison commented that he did not see correspondence from the Dept. of Conservation Division of Oil and Gas. Staff responded that they sent it out to them at the State level, but there were no comments received back. Commissioner Ellison requested a copy before Thursday's meeting if comments are received by the City. 6.9a&b) General Plan Amendment/Zone Change 04-1345 (Ward 5) Staff indicated that this is the only project that has a request for continuance and the applicant does not know that it would be until March. 6.10a&b) General Plan Amendment/Zone Change 04-1346 (McIntosh &Associates) (Ward 6 upon annexation) Staff report given. No opposition has been received by the City. Commissioner Lomas commented that this project is not like Snow Road. She requested that Staff have the width of Taft Highway for Thursday's meeting to reference as a buffer. 6.11a&b) General Plan Amendment 04-1347 (SmithTech USA, Inc.) (Ward 7) Minutes, PC, December 6, 2004 Page 7 Staff report given. Commissioner Lomas inquired about the ownership to which Staff responded they were not clear on that. She further inquired about the table referenced on page four which she does not have. Staff asked if Staff needs to have a condition ready to have the frontage, or some aspect of it, improved between this site and Union, to which Commissioner Lomas replied in the affirmative. Commissioner Gay inquired about the Snow Road zoning as he did not find it in his book, and Staff responded that it is a county 1 acre residential zone. 7. COMMUNICATIONS: None. 8. (COMMISSION COMMENTS: Commissioner Ellison thanked Staff and the Commissioners. 9.
