A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DECLARING URGENCY, DISPENSING WITH
ADVERTISING FOR BIDS, AND AUTHORIZING RETENTION OF
CONTRACTOR FOR REPAIR OR RECONSTRUCTION OF SEWER
MAIN AND STREET RIGHT-OF-WAY OF SOUTH CHESTER
AVENUE BETWEEN BRUNDAGE AVENUE AND RICHLAND STREET
FOR A DISTANCE OF APPROXIMATELY THREE HUNDRED
FEET.
WHEREAS, on June 18, 1986, a portion of a 39" sewer main
below the street right-of-way of South Chester Avenue, between
Brundage Avenue and Richland Street, had deteriorated to such degree
that it collapsed and undermined the roadway of South Chester Avenue,
designated an arterial street on the City's Circulation Element; and
WHEREAS, subsequent investigation has established that
approximately three hundred feet (300') of such sewer main and roadway
must be replaced or reconstructed, the main adjacent to the area of
collapse having been found to have deteriorated to the point of
imminent failure; and
WHEREAS, repair or reconstruction of such sewer main and
roadway at the earliest practicable time is necessary for the
preservation of life, health, and property, the collapsed sewer main
and roadway causing serious problems with traffic at the intersection
of an arterial and Freeway 58, with the safe transmission of raw
sewage to a wastewater treatment facility; and
WHEREAS, the danger of additional collapse or failure of the
sewer main within the 300' reach would further endanger traffic and
expose raw sewage, creating immediately health hazards.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
Pursuant to Section 136 of the City Charter and Section
3.20.060 of the Bakersfield Municipal Code, urgency is hereby declared,
advertising for bids is hereby dispensed with, and the Public
Works Director is hereby authorized to retain a qualified contractor
or contractors on a time and materials basis to make the necessary
repairs to or reconstruction of the sewer main and to South Chester
Avenue, the total cost of which shall not exceed $200,000.00 without
prior approval of this Council.
