PUBLIC STATEMENTS None. CONSENT CALENDAR a. Minutes of the regular meeting of August 8, 2004. Approval of department payments from July 30, 2004 to September 2, 2004 in the amount of $180,243.19 Motion by Bentley, seconded by Schroeder to approve the Consent Calendar. APPROVED REPORTS None. UNFINISHED BUSINESS None. ./- 0 6 Bakersfield, California, September 13, 2004 - Page 2 NEW BUSINESS Owner participation Agreement with Tact Development, LLC and the Bakersfield Redevelopment Agency to facilitate development of a Federal Courts Facility in the Downtown Bakersfield Redevelopment Area. Staff comments by Assistant to the City Manager Darnell Haynes, on loan to EDCD. Comments were made at this time regarding New Business items a. and b. Additionally, for the record, Mr. Haynes read a letter from Josephine and Christine Banducci: ~Mr. Charles Webb, Please read this on September 13, 04 at the 4:00 p.m. meeting. (Redevelopment Agency). We, Josephine and Christine Banducci would like to leave our property at 1025 18th Street AS iS for the following reasons: My father Fabio had this structure built in 1938 and ran it as an Italian Grocery. Christine continued to run it after our father died. This building is part of our life. We are both retired and the monthly income of $1400 is a blessing. The building is leased for another five years with the option of 10 more years. Is there enough space for all these projects in this area? The tenants have made many improvements and have much and expensive equipment to run their cable and communication business. This would be a waste. So, in closing we would like to keep it A._~_S I_~S. Thank you for reading this. Josephine and Christine Banducci" Phillip Ganong, Esq., spoke in favor of approving the Agreement. Chades Melton spoke in opposition to approval of the Agreement. Steve Biagiotti, President of SDA, Inc., provided information regarding willingness of property owners to sell area property. Ward Woolesen, Executive Director of the Kern County Employees Association, spoke regarding the issue. Motion by Prince, seconded by Martinez, to approve the Agreement. Owner participation Agreement with SDA Wilson, LLC and the Bakersfield Redevelopment Agency to facilitate development of a Federal Courts Facility in the Downtown Bakersfield Redevelopment Area. Staff comments combined with comments for item 6.a. Motion by Prince, seconded by Bentley, to approve the Agreement. Purchase of real property for the Old-Town Kern Mixed Use Project; Agreement between the Bakersfield Redevelopment Agency and Dalip Singh Sethi and Latika Kaur Sethi for $24,327.00 to purchase property located at 1025 Baker Street. Staff comments by Economic and Community Development Director Kunz. Motion by Davenport, seconded by Mishoe to approve the Agreement. ACTION TAKEN APPROVED NS DAVENPORT, SCHROEDER RA-04-013 APPROVED, NS DAVENPORT RA04-014 DEED 6t41 APPROVED d. Amendment No. 1 to Agreement No. 04-007 between the RA 04-007(~) Community Services Organization - Behavorial Health Programs and the Bakersfield Redevelopment Agency. Staff comments by Economic and Community Development Director Kunz. Motion by Bentley, seconded by Davenport to approve the Amendment to the Agreement. AGENCY STATEMENTS Member Mishoe stated he shares the concerns of Member Davenport regarding agenda items 6.a. and 6.b., particularly the issue of eminent domain proceedings. Member Davenport elaborated on concerns regarding possible eminent domain proceedings. Assistant City Attorney Shaw addressed Member Davenport's concerns. Member Bentley shares Member Davenport's concerns but feels the process will prevail. APPROVED 107 108 Bakersfield, California, September 13, 2004- Page 4 CLOSED SESSION None.
