A RESOLUTION DISPENSING WITH
NORMAL BIDDING PROCEDURES
DUE TO THE URGENT NEED TO DRILL
AND CONSTRUCT TVVO WATER
WELLS TO REPLACE WATER
PRODUCTION CAPACITY ON THE
DOMESTIC WATER SYSTEM
WHEREAS, the City of Bakersfield Domestic Water System suddenly has lost
water production capacity due to water quality concerns in existing water wells; and
WHEREAS, the drilling and construction of two new water wells must commence
immediately to be operational before the warm summer season arrives in 2005; and
WHEREAS, Municipal Code Section 3.20.060 (D)(4) provides that bidding may
be dispensed with pursuant to the procedures prescribed in this section and Section
136 of the city charter due to the urgent necessity for the preservation of life, health or
property; and
WHEREAS, under the authority of the above mentioned code, staff has obtained
three (3) bids on shortened notice; and
WHEREAS, because of the immediate need to commence drilling there is
insufficient time to obtain bids in the normal time frames; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1) The above recitals are true and correct and incorporated herein by reference.
2) The work and construction of drilling and testing of the water wells is hereby
declared, as a matter of fact, to be of urgent necessity for the preservation of life, health
and property.
3) The Finance Director is authorized to dispense with normal bidding
procedures in accordance with Section 3.20.060 of the Bakersfield Municipal Code.

adopted by the Council of the City of Bakersfield at a regular meeting thereof held on __
