HomeMy WebLinkAboutRES NO 036-05RESOLUTION 0 8 6" 0 5 RESOLUTION AMENDING EXPANSION NO. 20 OF THE BOUNDARIES OF THE SOUTHEAST METROPOLITAN BAKERSFIELD ENTERPRISE ZONE WHEREAS, the City of Bakersfield and the County of Kern, as joint applicants, have been designated as co-agents for the Southeast Metropolitan Bakersfield Enterprise Zone; and WHEREAS, Government Code Section 7074, as enacted by the State of California, permits a city or county to propose that the Enterprise Zone may be expanded by up to 20 percent of the original Enterprise Zone land area; and WHEREAS, the total Southeast Metropolitan Bakersfield Enterprise Zone was originally comprised of approximately 2,533 acres, of which approximately 915 acres were within the City, allowing for expansion of approximately 183 acres within the City portion of the Enterprise Zone; and, WHEREAS, prior expansions of that portion of the Enterprise Zone which lies within the City have amounted to approximately 111.98 acres, leaving approximately 71.02 acres for further expansion within the City portion of the Enterprise Zone. WHEREAS, the City previously approved Expansion No. 20 on May 12, 2004 via Resolution No. 179-04, and after a protracted review by the State, the State has requested changes to the previously selected expansion route in order to approve the expansion. WHEREAS, the City has agreed to the State's requested changes in order to approve the expansion. WHEREAS, the revised boundary expansion will require 98.26 acres, taking all of the remaining City expansion acreage of 71.02, and requiring the County of Kern to provide 27.24 expansion acres, which the County will provide via separate resolution. WHEREAS, the revised boundary expansion will also pass through a portion of the unincorporated County requiring the County of Kern to approve the expansion, which the County will provide via separate resolution. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Bakersfield as follows: 1. The Council does hereby adopts a revised boundary expansion to the Southeast Metropolitan Bakersfield Enterprise Zone as described in Exhibits A and B attached herewith which would be contiguous to the Enterprise Zone designated boundaries. 3. The proposed expansion contains approximately 98.26 acres. 4. The Council does commit and assure that the adopted Enterprise Zone incentives will apply to the revised expansion and remain in full force and effect through the life of the Enterprise Zone or any extensions thereof. 5. The Council hereby directs the City Manager to execute and submit the required documentation to the California Business, Transportation and Housing Agency, for review and final approval of the revised boundary expansion to the previously approved Expansion No. 20.
