ROLL CALL Present: Commissioners Tragish, Ellison, Blockley, Gay, Lomas, Spencer, Tkac Absent: None Advisory Members: Robert Sherfy, James D. Movius, Marian Shaw, Jack Leonard Staff: Pam Townsend 2. PLEDGE OF ALLEGIANCE: 3. PUBLIC STATEMENTS: Bob Smith, from SmithTech USA, Inc., asked for a continuance of Tract 6361 for two weeks. 4. CONSENT CALENDAR: 4.1 Non-Public Hearing Items 4.1 a Approval of minutes for Planning Commission meetings of December 6, 9 & 16, 2004 and January 6 &20, 2005. 4.1 b Approval of General Plan Consistency finding for the proposed permanent closure of pedestrian walkways on the north side of Stockdale Highway. (City of Bakersfield). (Exempt from CEQA) (Ward 1) Commissioner Lomas corrected a portion of the minutes from December 9, 2004, Page 5, Paragraph 6 should read 'h acre lots instead of 1 acre lots. Motion made by Commissioner Blockley, seconded by Commissioner Spencer, to approve the non-public hearing portion of the Consent Calendar. Motion carried by group vote. 4.2 Public Hearing Items 4.2a Approval of Vesting Tentative Tract Map 6332 (Phased) (SmithTech USA, Inc.). (Ward 6) 4.2b Approval of Vesting Tentative Tract Map 6364 (SmithTech USA, Inc.) (Ward 4) 4.2c Approval of Zone Change No. 04-1508 (DeWalt Corp) (Ward 4) Minutes, PC, February 17, 2005 Page 2 Public portion of the hearing opened. No one spoke either for or against the projects. Public portion of the hearing closed. There were no Commission comments. Motion made by Commissioner Gay, seconded by Commissioner Ellison, to approve the public hearing portion of the Consent Calendar. Motion carried by group vote. 5. PUBLIC HEARING —General Plan Amendment 04-1762 (Porter-Robertson) (Ward 7) Marian Shaw, from the Public Works Department, gave the staff report recommending approval. Public portion of the hearing opened. Barry Goldner, representing Venture Out RV dealership on Colony Street, stated their concerns regarding the proposed change. They are worried that there will be a significant increase in traffic. Mr. Goldner said that all of the property on both sides of Colony Street are subject to a recorded reciprocal easement agreement. He also said they have a concern that the change of the roadway to become a collector will require certain improvements which could result in possibly the creation of some sort of maintenance district or assessment district. They feel that Venture Out RV and Panama Lane Associates are doing just fine with Colony Street as a private roadway and do not require any additional improvements for the purpose of their use of the property. Mike Lee, representing the applicant, added that everyone south of the canal except the ten acre corner is represented as an applicant. The application is more than Mr. Owadi. They agree with staff's recommendation and are available to answer any questions the Commission may have. Clyde Barbeau, John Guimara Jr. and Mike Stier, property owners, all spoke in favor of the application. Public portion of the hearing was closed. Commissioner Gay asked if a 90-foot alignment would come too close to the structure? Ms. Shaw said this is just a conceptual plan. They do have leeway for minor variations. Commissioner Gay asked if the city would look at normal setbacks? Ms. Shaw said they would certainly look at them. Commissioner Gay asked if by approving this if Mr. Owadi will put in the street north of the Arvin-Edison Canal and the Arvin-Edison Canal crossing? Ms. Shaw said it is Mr. Owadi's requirement to provide access to his site. Commissioner Spencer said that Colony Street will not connect to Hosking Avenue because of the potential interchange or connection? Ms. Shaw said yes that is correct. Commissioner Ellison asked if the collector being proposed fits in with the general plan land use designations south of the Arvin-Edison Canal. Mr. Movius said that south of the canal down Berkshire Road there is 65 acres of commercial and then south of that is residential. It would serve both properties very well. Commissioner Lomas said that the applicant said the road can't go through to Hosking because of Caltrans and the fact that there is not enough room between Highway 99 and "H" and wondered if this is correct? Ms. Shaw said there is not enough room to get a major road out on that segment of roadway. Minutes, PC, February 17, 2005 Page 3 Commissioner Tragish asked how wide Colony is right now? Ms. Shaw said she did not know. The right-of-way for a four lane collector is 90 feet. Curb-to-curb is about 70 feet. Commissioner Tragish asked how many lanes will Colony have when it is extended? Ms. Shaw said a collector is setup for four lanes of traffic. Commissioner Tragish asked what kind of notice do we give the property owners" Ms. Shaw said that obtaining the right-of-way down to the canal is a requirement that Mr. Owadi has right now. He is currently negotiating with the property owners for the right-of-way. Commissioner Tragish asked Mr. Goldner if there has been any negotiations regarding the alignment of Colony for the collector? Mr. Goldner said there have been negotiations between his clients and Mr. Owadi and his Counsel with regard to a number of issues. There were no more Commissioner comments. Motion made by Commissioner Gay, seconded by Commissioner Tkac, to adopt a resolution making findings as set forth in the staff report approving the Negative Declaration and approving the requested general plan amendment to add Colony Street as a collector south from Panama Lane to approximately 1/8 mile north of Hosking Avenue to add an unnamed collector from South "H" Street to Colony Street and add Berkshire Road as a collector from South "H" Street to Colony Street as shown on Exhibit 1 and also make a recommendation to staff to delete the pre- meeting on February 14 and recommend same to City Council. Motion carried by the following roll call vote: AYES: Commissioners Blockley , Ellison, Gay, Lomas, Spencer, Tkac, Tragish NOES: None ABSENT: None 6. (Ward 4) See Consent Agenda 7. VESTING TENTATIVE TRACT 6361 (SmithTech USA) (Ward 4) Mr. Movius said that the applicant and property owner have requested a continuance until March 3, 2005. Motion made by Commissioner Gay, seconded by Commissioner Spencer, to continue this item until March 3, 2005. Motion carried by group vote. Minutes, PC, February 17, 2005 Page 4 8. PUBLIC HEARING —Zone Change No. 04-1508 (DeWalt Corp) (Ward 4) See Consent Agenda 9. COMMUNICATIONS: Mr. Movius requested that anyone interested in going to the Planner's Institute to let him know. Mr. Movius reminded the Commission that there is a special presentation on the sewer treatment plant expansion and air quality next Thursday at 5:45 in the Development Services Building. Dinner will be served at 5 p.m. Mr. Movius said this will be what he feels a factual presentation on air quality. It will refute some of the concepts that have been put before the Commission by non-professionals. 10. COMMISSION COMMENTS: None 11.
