Home My WebLink AboutROI NO 1372RESOLUTION OF INTENTION NO. 1372 A RESOLUTION DECLARING INTENTION TO ESTABLISH THE DRAINAGE PLAN FOR THE GOLDEN VALLEY PLANNED DRAINAGE AREA AND PRELIMINARILY APPROVING THE BOUNDARIES OF THE AREA AND THE COST AND FEE SCHEDULE. RECITALS WHEREAS, Chapter 16.32.060.D of Title 16 of the Bakersfield Municipal Code and Section 66483 of the California Government Code, provides for a procedure by which the City Council may assess and collect fees for the purpose of defraying the cost of constructing drainage facilities for local and neighborhood drainage areas, and; WHEREAS, The City of Bakersfield desires to provide storm and surface water drainage facilities for a rapidly developing area containing approximately 170 acres, in order to prevent drainage damage to land development within the area and to properly control storm and surface water run-off from said area, and; WHEREAS, the City is proposing the formation of the Golden Valley Planned Drainage Area to pay for construction of those drainage facilities not yet built that serve the area identified in Exhibit A (attached hereto and incorporated by reference) and to reimburse the cost of the improvements already constructed upon subdivision or development of property within the area, and; WHEREAS, the fees set forth in Exhibit "B"" attached hereto and incorporated by reference, do not exceed the reasonable estimated cost of providing the services for which the fees are charged; and WHEREAS, the construction costs for the drainage facilities are set forth in Exhibit "C" attached hereto and incorporated by reference. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The foregoing recitals are true and correct and are incorporated herein. 2. The Council hereby preliminarily approves the boundary of the "Golden Valley Planned Drainage Area" as described on the map attached hereto as Exhibit A, the fee schedule attached hereto as Exhibit B, and the cost estimate attached hereto as Exhibit C.
