HomeMy WebLinkAboutRES NO 055-05RESOLUTION NO. 0 ~ 5 - 0 5 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADOPTING DRAINAGE PLAN FOR THE GOLDEN VALLEY PLANNED DRAINAGE AREA AND MAKING FINDINGS RELATIVE THERETO. RECITALS WHEREAS, the City Council by Resolution of Intention No. 1372, adopted March 9, 2005, in the Council chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, identified the Golden Valley Planned Drainage Area, and; WHEREAS, the new project will complete the pipeline system that will drain water to a central basin, and; WHEREAS, the completion of the project will improve the efficiency of the storm water drainage facilities in the benefit area, and; WHEREAS, the City Council finds that the completion of the system is in the best interest for the health, safety and welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing recitals are true and correct and incorporated herein by reference. 2. The Golden Valley Planned Drainage Area has been identified as necessary for the removal of surface and storm waters from the local and neighborhood drainage areas. 3. The Council hereby finds that, as to the Golden VaLley Planned Drainage Area, as described in the plans and maps attached hereto and incorporated herein by reference, subdivision and development of property within each such area will require construction of facilities, described in each such area either on the basis of benefits conferred on property for subdivision or on the need for such facilities created by the proposed subdivision and development of other property within such area, and that the fees provided within the schedule attached, are fairly apportioned. 4.
