A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO EMERGENCY REPAIRS RESULTING FROM STORM DAMAGE AND ENVIRONMENTAL CLEAN-UP, DOWNTOWN BAKERSFIELD, NOT TO EXCEED $200,000 WHEREAS, on Friday, March 4, 2005, a high intensity thunder storm hit the Bakersfield area causing many areas of localized flooding including an area near 24th Street and Chester Avenue; and WHEREAS, City crews were immediately dispatched to the area and discovered the Aamco Transmission Repair shop at 2415 Chester Avenue had flooded causing a large amount of transmission fluid to spill within an estimated four (4) block area (bounded by H Street on the West, Chester Avenue on the East, 26th Street an the north and 23rd Street on the south); and WHEREAS, storm water drainage within this area is collected in a series of underground storm drains that discharges to the Kern River; and WHEREAS, the portions of 23rd Street and 24th Street within the transmission fluid spill area are within the jurisdiction of the California Department of Transportation (CalTrans); and WHEREAS, when City crews reached the spill site, CalTrans had already dispatched an environmental clean-up crew to contain and mitigate the transmission oil spill within CaITrans right of way; and WHEREAS, the Public Works Director determined that due to the sensitive nature of the Kern River storm drain outfall, this problem was declared and emergency and the work to be performed was of urgent necessity for the preservation of life, health or property; and WHEREAS, the Public Works Director also determined that the environmental clean-up crew that had been dispatched by CalTrans was best suited to perform the necessary clean-up work within Bakersfield City jurisdiction and therefore directed that crew to perform the work on a time and materials basis. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The above recitals are true and correct and incorporated herein by reference. G:\GROUPDATXADM IN RPT~.005~03-09\Emergency Resolution.doc Page lof3 2. City Council hereby determines that based on the above recitals the work performed was of urgent necessity for the preservation of life, health or property, thereby allowing the dispensing of bidding requirements as set forth in Section 136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code. 3. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code, and is further authorized to expend an amount not to exceed $200,000 for environmental clean-up. ..... o0o .....
