HomeMy WebLinkAboutRES NO 169-85RESOLUTION NO. 169-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD SETTING DATE AND PLACE OF PUBLIC HEARING IN MATTER OF PROPOSED CANCELLATION OF LAND USE CONTRACT UNDER THE WILLIAMSON ACT, AND DIRECTING CITY CLERK TO GIVEN NOTICE IN ACCORD WITH SECTION 51284 OF THE GOVERNMENT CODE. WHEREAS, JOHN M. ANTONGIOVANNI and YOLE J. ANTONGIOVANNI, husband and wife as joint tenants, and J. STANLEY ANTONGIOVANNI and KATHLEEN E. ANTONGIOVANNI, husband and wife as joint tenants, collectively, on September 16, 1985, filed with the City of Bakersfield a petition for cancellation of a Land Use Contract, which contract was entered into under the Land Conservation Act of 1965 (Williamson Act), and which land is located in County of Kern Agricultural Preserve No. 10. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That in accordance with the provisions of the Williamson Act, a public hearing on the Petition of JOHN M. ANTONGIOVANNI and YOLE J. ANTONGIOVANNI, husband and wife as joint tenants, and J. STANLEY ANTONGIOVANNI and KATHLEEN E. ANTONGIOVANNI, husband and wife as joint tenants, collectively, is hereby set for Wednesday, the 11th day of December, 1985, at the hour of 7 p.m. or as soon thereafter as the matter may be heard, at the Council Chambers in City Hall, 1501 Truxtun Avenue, Bakersfield, California; and 2. That the City Clerk is hereby directed to give notice of the hearing in accordance with Section 51284 of the Government Code; and 3. That the notice as aforesaid shall be in substan- tially the following form: NOTICE OF PUBLIC HEARING In the Matter of Proposed Cancellation of Land Use Contract with Respect to Land Under the Williamson Act. NOTICE IS HEREBY GIVEN that the Council of the City of Bakersfield has fixed Wednesday, the 11th day of December, 1985, at the hour of 7 p.m. or as soon thereafter as the matter may be heard, at the Council Chambers in City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hear- ing on the matter of the petition filed by JOHN M. ANTONGIOVANNI and YOLE J. ANTONGIOVANNI, husband and wife as joint tenants, and J. STANLEY ANTONGIOVANNI and KATHLEEN E. ~NTONGIOVANNI, husband and wife as joint tenants, collectively, for cancellation of a Land Use Contract with respect to land under such contract, which contract was entered into between the petitioners and the County of Kern on February 28, 1969, and recorded in Official Records in Book No. i at Page 39, Kern County Recorder's Office. The land for which cancellation is sought consists of approximately 135.027 acres located in Agricultural Preserve No. 10 located in the City of Bakersfield since annexation thereof in July 22, 1985, and more particularly described in Exhibit "A" attached hereto and incorporated in this resolution by such reference as though fully set forth herein. Said petition is on file with the City Clerk of the City of Bakersfield at City Hall, 1501 Truxtun Avenue, Bakersfield, California, and may be examined by any interested person during regular office hours.
