HomeMy WebLinkAboutRES NO 095-05RESOLUTION NO. 0 9 ,5 - 0 ,5 A RESOLUTION DECLARING REAL PROPERTY SURPLUS TO THE NEEDS OF THE CITY AND AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE ITS SALE WHEREAS, on February 1, 1991, the City acquired a fee ownership in 11.585 acres located in East half of Section 18, Township 29 South, Range 28 East, M. D. B. & M. located north of Panorama Drive and east of Morning Drive; and, WHEREAS, Stepping Stone Land Development has requested the City sell a portion (approximately 8 acres) of this property described in Exhibit "A" and shown on Exhibit 'B" attached hereto to facilitate its development. WHEREAS, the Planning Commission will be asked to find the sale of this property to be consistent with the Metropolitan Bakersfield 2010 General Plan pursuant to Government Code Section 65402. WHEREAS, Bakersfield Municipal Code 3.20.125 authorizes the negotiated sale of City property deemed to be "surplus". NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing findings and recitals are true, correct, and incorporated herein. 2. Real Property located in the East half of Section 18, Township 29 South, Range 28 East, M. D. B. & M. located north of Panorama Drive and east of Morning Drive is hereby declared surplus to the City's needs and the Finance Director is authorized to negotiate its sale. The real property is more fully described in Exhibits "A" and "B" attached hereto and incorporated as though fully set forth.
