HomeMy WebLinkAboutRES NO 093-05RESOLUTION NO. 0 9 3 - 0 $ A RESOLUTION ESTABLISHING SEWER AND STORM SEWER SERVICE USER CHARGES. WHEREAS, Chapter 14.12 of the Bakersfield Municipal Code authorizes the establishment and increase of fees and charges to recover costs for services rendered; and WHEREAS, a public hearing before the City Council was advertised twice in the Bakersfield Californian, a newspaper of general circulation; and WHEREAS, a public headng was held to determine whether the proposed fees and charges are discriminatory or excessive; and WHEREAS, the fees and charges set forth in Exhibit "A" and Exhibit "B", attached hereto and incorporated by reference, do not exceed the reasonable estimated cost of providing the services for which the fees are charged. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD AS FOLLOWS: 1. The above recitals and findings are true and correct and are incorporated herein by reference. 2. The fees and charges set forth in Exhibit "A" and Exhibit "B" are hereby adopted and shall become effective on July 1, 2005. 3. The adoption of these fees and charges complies with Proposition 218. 4. Pursuant to the Bakersfield Municipal Code, the fees and charges herein shall be collected by the Kern County Tax Collector on the property tax rolls. ............ o0o .............. The surcharge for the excesses shall be as follows: Flow, MG BOD, mg/L TSS, mg/L $910.00/MG/yr. $65.50/1000 lb. $73.50/1000 lb. aFIow will be estimated based on water consumption records during the three (3) winter months from December to February. II. Septic Discharges 1. Permit Application Fee, shall be $20.00 2. Septage Discharge Permit Fee, shall be $100.00 3. Septage Discharge Permit Renewal Fee, shall be $50.00 4. The rate per gallon, shall be $0.021 5. The surcharge for outside septage discharges, (septage originating outside the city limits) the rate per gallon, shall be $0.021 This surcharge is to recover capital expenditures and administrative costs. III. Surcharge for Outside Users $57.80/yr./con nection This surcharge includes two components: $31.25/yr./connection for a capacity charge, which shall be for the purpose of reserving a portion of City's trunkline and sewage treatment facilities for the applicant. (Typical for single family dwelling); and 2. $26.55/yr./connection for recovery of subsequent City capital costs. IV. IndustriaIWaste Discharqe Monitoring 1. Application Fee 2. WastewateflStormsewer Apportionment The rates contained in this exhibit cover 100% of costs reasonably incurred in providing the operation, maintenance, replacement, and capital improvements of the existing wastewater plants, sewers, and storm sewer systems. Eighty-six (86) percent of said rates are attributable to sanitary sewer use, maintenance, replacement and improvements and fourteen (14) percent of said rates are attributable to storm sewer use, maintenance, replacement and improvements.
