AN ORDINANCE OF THE CITY TO BAKERSFIELD
ADDING SECTION 2.28.120 TO CHAPTER 2.28 OF THE
BAKERSFIELD MUNICIPAL CODE RELATING TO
GENERAL PLAN CONSISTENCY FINDINGS.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION1.
Chapter 2.28.120 of the Bakersfield Municipal Code is hereby added to read as fellows:
2.28.120 Planning department - - General plan consistency findings.
All general plan consistency findings required by Govemment Code Section 65402, as
the same may be amended, shall be made by the planning director or his/her designee.
No general plan consistency findings shall be required for (1) the disposition of the
remainder of a larger pamel which was acquired and used in part for street purposes;
(2) acquisitions, dispositions, or abandonments for street widening; or (3) alignment
projects, provided such dispositions for street purposes, acquisitions, dispositions or
abandonments for street widening, or alignment projects are of a minor nature.
SECTION2.
This Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and after
the date of its passage.
