CONSENT CALENDAR: 4.1 Non-Public Hearing Items 4.1 a Approval of minutes for the Planning Commission meeting of March 3, 2005. Motion made by Commissioner Ellison, seconded by Commissioner Lomas, to approve the non- public hearing portion of the Consent Calendar. Motion carried by group vote. 4.2 Public Hearing Items 4.2a Approve Extension of Time for Revised Vesting Tentative Tract 6056 (Porter-Robertson Eng) (Ward 3) 4.2b Approval of Vesting Tentative Parcel Map 11246 (McIntosh & Associates) (Ward 1) 4.2c Approval of Vesting Tentative Parcel Map 11220 (Porter-Robertson) (Ward 7) 4.2d Approval of Planned Development Review 04-1716 (Porter-Robertson) (Ward 7) 4.2e Approval of Vesting Tentative Tract 6410 (Delmarter& Deifel) (Ward 6) 4.2f Approval of Vesting Tentative Tract 6331 (SmithTech USA, Inc) (Ward 1) 4.2g Approval of Vesting Tentative Tract 6387 (Pacific Engineering Associates) (Ward 6) Minutes, PC, April 21, 2005 Page 2 4.2h Approval of ADMINISTRATIVE PUBLIC HEARING — Request to vacate (remove) emergency access easement from 8000 and 8004 Latham Court (File No. 05-0231). (Nelms Surveying) (Ward 3) Public portion of the hearing opened. No one spoke either for or against the projects. Commissioner Gay requested that item 4.2f be removed from the Consent Calendar. Commissioner Tkac declared a conflict of interest on item 4.2e and would not be voting on that project. Commissioner Lomas requested that item 4.2b be removed from the Consent Calendar. Public portion of the hearing closed. Motion made by Commissioner Gay, seconded by Commissioner Tkac, to approve the public hearing portion of the Consent Calendar with the exclusion of 4.2b &4.2f. Motion carried by group vote. 5. PUBLIC HEARINGS —Tentative Parcel Maps 5.1 Vesting Tentative Parcel Map 11246 (McIntosh &Associates) (Ward 1) Public portion of the hearing opened. Staff report given recommending approval subject to conditions contained in the staff report. No one spoke in opposition to the project. Roger McIntosh stated that they agree with the conditions of approval and he is available to answer any questions. Public portion of the hearing was closed. Commissioner Lomas asked if the driveway to the north is too close to the on-ramp and if there are any restrictions for that? Steve Walker, Traffic Engineer, said the driveway is about 200 feet from the intersection and it is restricted to a right-turn in, right-turn out. The median and openings in the median have already been defined in the general plan amendment. Commissioner Lomas asked if there is a restriction to how a driveway can be put to an off-ramp? Mr. Walker said the limit imposed by Caltrans would be at parcel one. The city likes to keep them at least 150 to 200 feet. Commissioner Lomas asked what "cross access easement" means and whether it pertains to this site? Mr. Movius said sometimes we do have a inconsistency between conditions and we are trying to get it lined out. With regard to commercial shopping centers, we always make sure we address that ability some way or another. There could be a slight difference in wording. There were no more Commissioner comments. Motion made by Commissioner Lomas, seconded by Commissioner Tkac, to approve Vesting Tentative Parcel Map 11246 with findings and conditions set forth in attached resolution and incorporate April 21 memorandum from Marian Shaw. Motion carried by the following roll call vote: AYES: Commissioners Blockley, Gay, Ellison, Lomas, Tkac, Tragish NOES: None ABSENT: Commissioner Spencer Minutes, PC, April 21, 2005 Page 3 5.2a&b Vesting Tentative Parcel Map 11220/Planned Development Review 04-1716 (Porter- Robertson) (Ward 7) See Consent Calendar 6. PUBLIC HEARINGS —Tentative Tract Maps 6.1 Vesting Tentative Tract 6410 (Delmarter& Deifel) (Ward 6) See Consent Calendar 6.2 Vesting Tentative Tract 6331 (SmithTech USA, Inc) (Ward 1) Public portion of the hearing opened. Staff report given recommending approval subject to conditions contained in the staff report. No one spoke in opposition to the project. Bob Smith, representing SmithTech USA, Inc., stated they were in agreement with the staff report and the conditions. Mr. Smith said it is his understanding they have a surface waiver, not that the mineral owners are going to sign the final map. Public portion of the hearing was closed. Commissioner Gay said the north/south streets appear to be 40 feet and wondered if the applicant owns the property to the east assuring that they will get the rest of the 60-foot right-of-way? Ms. Shaw said this is covered in the City's subdivision ordinance. They are called boundary streets. The first guy in is required to build 40 feet of the street. Quite often they will center the street on the tract boundary and get some sort of easement from the adjacent property owner to build the additional 10 feet. In this case, they offset the street so the entire 40 feet is within the boundary of this map. Commissioner Gay asked if it would be appropriate to modify condition 3 to stipulate that in addition to the one street to the south, two streets to the west connecting to Union Avenue. Ms. Shaw said that in the memo that was submitted, they addressed the elimination of condition 12. It was a partial duplication of condition two which does reference Hosking. Regarding condition 3 — the language does provide the two streets to the west. Commissioner Tragish asked if there is a fire access to the property as built in this map? Ms. Shaw said this subdivision is designed so that if any of the local intersections interior to it are blocked, it looks like there is another way around. There were no more Commissioner comments. Motion made by Commissioner Gay, seconded by Commissioner Blockley, to approve and adopt the Negative Declaration and to approve Vesting Tentative Map 6331 with findings and conditions set forth in the attached resolution Exhibit A incorporating the memorandum dated April 18 by Marian Shaw and recommend the same to the City Minutes, PC, April 21, 2005 Page 4 Council. Motion carried by the following roll call vote: AYES: Commissioners Blockley , Gay, Ellison, Lomas, Spencer, Tkac, Tragish NOES: None ABSENT: Commissioner Spencer 6.3 Vesting Tentative Tract 6387 (Pacific Engineering Associates) (Ward 6) See Consent Calendar 6.4 Vesting Tentative Tract 6429 (Porter-Robertson Engineering) (Ward 4) Public portion of the hearing opened. Staff report given recommending approval subject to conditions contained in the staff report. No one spoke in opposition to the project. Fred Porter, representing the applicant, stated they are in agreement with staff's recommendations. Public portion of the hearing was closed. Commissioner Lomas asked if they should make condition 23 state a minimum height for the block wall? Mr. Movius said it should state a minimum of 6 feet. Commissioner Lomas had a question about what looks to be a protrusion into the roadway. Ms. Shaw said the tract map follows the boundary of the Westside Parkway. There is an allowance for a slope easement. There were no more Commissioner comments. Motion made by Commissioner Ellison, seconded by Commissioner Lomas, to approve Tentative Tract Map 6429 with findings and conditions set forth in the attached resolution to include a change in Condition 23 to include 6 foot block walls. Motion carried by the following roll call vote: AYES: Commissioners Blockley ,, Gay, Ellison, Lomas, Tkac, Tragish NOES: None ABSENT: Commissioner Spencer 7. COMMISSION COMMENTS: Commissioner Gay's term as Planning Commissioner has been extended through the July 7, 2005. Commissioner Gay said that he has noticed a lot of off-premise signs and would like to see the Kiosk sign program implemented in the new areas of town. 10.
