A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING A
NEGATIVE DECLARATION, APPROVING AND ADOPTING
A REVISED NOISE ELEMENT OF THE BAKERSFIELD
METROPOLITAN AREA GENERAL PLAN.
WHEREAS, the existing Noise Element was adopted by the
Bakersfield City Council on November 17, 1975; and
WHEREAS, Government Code Section 65301(f) requires that
each local government adopt a noise element in accordance with
guidelines established by the Office of Noise Control of the
State Department of Health Services; and
WHEREAS, this revised Noise Element is intended to
replace the existing Noise Element; and
WHEREAS, the Planning Commission, in accordance with the
provisions of Section 65351 of the Government Code, held a public
hearing on August 1, 1985, on the proposed revised Noise Element
of the Bakersfield Metropolitan Area General Plan, notice of time
and place of hearing having been given at least ten (10) calendar
days before said hearing by publication in a local newspaper of
general circulation; and
WHEREAS, all matters presented at said hearing were duly
considered by the Planning Commission; and
WHEREAS, for this proposed revised Noise Element of the
Bakersfield Metropolitan Area General Plan, an Initial Study was

Commission adopted its Resolution No. 104-85, approving and
adopting said Negative Declaration, recommending that this
Council adopt the revised Noise Element and forwarding to this
Council the record of proceedings before the Planning Commission,
which record has been fully considered by this Council; and
WHEREAS, the Law and Regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution No. 132-83 have been duly
followed; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted a public hearing on November 13, 1985, on the
proposed revised Noise Element, notice of time and place of hear-
ing having been given at least ten (10) calendar days before the
hearing by publication in the Bakersfield Californian, a newspa-
per of general circulation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. The above recitals, incorporated herein, are true
and correct.
2. The Negative Declaration for the revised Noise
Element of the Bakersfield Metropolitan Area General Plan is
hereby approved and adopted.
3. The revised Noise Element is hereby approved and
adopted.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
regular meeting thereof held on the l~h day of November ,
