HomeMy WebLinkAboutRES NO 151-85RESOLUTION NO. 151-85 A RESOLUTION OF APPLICATION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO T~E CITY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 306 (CASTRO NO. 4). WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 35140 of the Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the Council of the city of Bakersfield that it hereby finds and determines as follows: 1. That the City of Bakersfield hereby proposes the annexation to the City of Bakersfield of the territory described in Exhibit "A", attached hereto and made a part of this resolu- tion as though fully set forth herein. 2. That a map of the territory proposed to be so annexed, marked Exhibit "B", is attached hereto and made a part of this Resolution as though fully set forth herein. 3. That a Plan for providing services within the affected territory of the proposed annexation, in accordance with the provisions of Section 35102 of the Government Code, is marked as Exhibit "C", attached hereto and made a part hereof as though fully set forth herein. 4. That this proposal for change of organization, to wit, annexation, is made pursuant to the Municipal Organization Act of 1977 (Part 2 of Division 2 of Title 4 of the Government Code of the State of California, commencing with Section 35000 thereof), and it is requested that proceedings be authorized for annexation in accordance therewith. 5. That the reasons for the proposed change of organi- zation are that the owners and residents of the affected terri- tory desire to receive municipal services from the City of Bakersfield, and the City desires to receive tax revenues for benefits given and to be given to the territory proposed to be annexed. 6. That for this proposed annexation and the zoning upon annexation therefor, the ordinance for which was adopted this date, an Initial Study was conducted and it was determined that the proposed projects would not have a significant effect on the environment, and a Negative Declaration was prepared. 7. That the laws and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in the California Environmental Quality Act and City of Bakersfield Resolution No. 83-132 have been duly folowed and the Negative for this proposed annexation is hereby approved and Declaration adopted. 8. Fire Station No. 7 is approximately ~ mile southwesterly of the annexa- tion at Akers Road and Soranno Avenue. Station No. 3 at 3400 Palm St. is approximately ~ mile northwesterly. Parks and Rccreatioll Wayside Park is approximately ¼ mile easterly between So. "H" St. and So. Annexation will not affect City fire service capabilities. The City will not require any upgrading or changes in existing facilities with the exception of two additional fire hydrants recommended by the City Fire ~epartment at City expense. Should the residgnts of Castro No. Q want area wide sewers, curbs, gutters and sidewalks~ the City w~uld assist them in establishin~ a Public Improvement District to finance installation of these imnrovements. Indicate and explain existing zoning in affected territory. See attached zoning maps 123-1 and 102-36. The area is. primarily zoned R-l(one family dwelling). Also throughout area are R-2, R-3 and R-/% zoning (multiple family dwellings), R-5 and E-3 zoninM (larger single family lots which allow large en~ma~s), C-0 Zoninm <for office uses) and ~-1 and C-2 zonin~ (for commerc{al uses). VI. Indicate and explain proposed prezonin~ in'are~. (List effects on present land use ~hat would occur as a resul~ of annexation such as maintenance of livestock on property, e~c.) Castro No. ~ is fully developed into existing land use (see V above). The City pre-zonin~ districts are eomnatible with and are intended to accomodate all existing land uses. There would be no effect on the present land use. VII. List city services that area will directly or indirectly bene£it from such as decrease in fire insurance rate, shorter emergency response tSme, use of com- m'un.i~y facilities, etc. City police should be able to respond in a more timely manner than present County Sheriff service and Stage Highway Fatrol. Current City police standard is 1.65 sworn officers per 1000 population compared to the County standard of'l.15. Certain areas within the annexation boundaries have already ob- tained City sewer service. Other services such as sgree% maintenance/construction, street sweeping, planning, etc. will be provided upon annexation. The area will directly benefit from these services in a more efficient and economical manner. VIII.
