A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO THE EMERGENCY REPLACEMENT OF THE HV AC CHILLER UNIT THAT SERVES THE RABOBANK THEATER AND CONVENTION CENTER, NOT TO EXCEED $145,000. 11'"1 9 - 05 WHEREAS, the main cooling system for the Rabobank Theater and Convention Center is provided by two chillers that produce chilled water which is used to cool the air that is dispensed throughout the building; and WHEREAS, one chiller is a 175-ton unit that is used for the daily cooling of the administrative offices and meeting rooms when needed. The second chiller is a 300-ton unit that operates when the demand for cooling is greater than the 175-ton unit can produce; and WHEREAS, in March 2005, the City HV AC Technicians reported disturbing noises coming from a 175-ton chiller unit that provides cooling to the Rabobank Theater and Convention Center, immediately shut it down and reprogrammed the system to operate only with the 300-ton unit: and WHEREAS, the City of Bakersfield contracted with TRANE Co. to determine the cause of the noises and suggest the best course of action; and WHEREAS, on Friday, April 29, 2005, the City received a verbal estimate of repairs to the chiller to be $50,000; and WHEREAS, the Public Works Director determined it would not be cost effective to spend $50,000 to repair a 12-year-01d piece of mechanical equipment; and WHEREAS, due to the approaching hot weather season and the expected manufacturing lead time being ten weeks or more, there is a high probability that the present operating condition would be insufficient for events during the summer months. Inadequate cooling could cause harmful health effects to event staff, performers, and customers and could cause the cancellations of events; and WHEREAS, to remedy this emergency situation, the Public Works Director authorized a contract with TRANE Company to provide and install a new Helical Rotary 125 ton chiller that will provide sufficient cooling capacities and provide energy efficiency. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The above recitals are true and correct and incorporated herein by reference. 2. City Council hereby determined that based on the above recitals the work performed was of urgent necessity in provide proper cooing and operation of the Rabobank Theater ~ 'òÞ.Kf1) Convention Center, thereby allowing the dispensing of bidding requirements as set forth in"-- ~ Section 136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code.
