HomeMy WebLinkAboutRES NO 141-85 RESOLUTION NO. 141-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, STATE OF CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 12. WHEREAS, by Resolution of August 28, 1985, a public hearing was called for September 25, at the hour of 7:00 p.m., in the Council Chambers in the City Hall, Bakersfield, California, to ascertain whether the public necessity, health, safety or general welfare require the removal of poles, overhead wires and associated overhead structures and underground installation of wires and facilities for supplying electric, communication, cable television or similar and associ- ated services, within that certain area, more particularly described as follows: Intention No. 990 adopted on 1985, DESCRIPTION DIVISION 12 Beginning at the intersection of the north line of 16th Street and the west line of "H" Street; Thence (1) westerly along said north line o~ 16th Street to intersect the east line of "E" Street; Thence (2) northerly along said line of "E" Street 130'~; Thence (3) westerly at right angles 82.5'~ to intersect the west line of "E" Street; Thence (4) southerly along said west line of "E" Street to inter- sect the north line of 16th Street; Thence (5) westerly along said north line of 16th Street to intersect the east line of "A" Street; Thence (6) northerly along said east line of "A" Street 130'~; Thence (7) westerly at right angles 82.5'~ to intersect the west line of "A" Street; Thence (8) southerly along said west line of sect the north line of 16th Street; Thence (9) westerly along said north line of 16th Street 40'~; Thence (10) southerly at right angles 82.5'~ to intersect the south line o~ 16th Street; Thence (11) easterly along said south line of 16th Street to intersect the west line of "D" Street; Thence (12) southerly along said west line of "D" Street 100'~; "A" Street to inter- Thence (13) easterly at right angles 82.5'~ to intersect the east line of "D" Street; Thence (14) northerly along said east line of "D" Street to intersect the south line of 16th Street; Thence (15) easterly along said south line of 16th Street to intersect the west line of "H" Street; Thence (16) northerly along said west line of "H" Street to the Point of Beginning. Notice of such hearing has been given to all affected property owners as such are shown on the last equalized assess- ment roll and to all utilities concerned in the manner and within the time required by law; and Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to appear and be heard. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that, pursuant to Chapter 12.32 of Title 12 of the Municipal Code of the City of Bakersfield, the above- described area is hereby declared an underground utility district and is designated as Underground utility District No. 2, Division 12, of the city of Bakersfield. Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this Resolution is a map or diagram entitled as follows: UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 12, delineating the boundaries of said District. BE IT FURTHER RESOLVED that the electric utility which undertakes underground installation of its facilities shall use the underground conversion allocation computed pursuant to deci- sions of the Public Utilities Commission of the State of California for the purpose of providing to each premises in Underground Utility District No. 2, Division 12, requiring it (a maximum of one hundred feet of individual electric service trenching and conductor [as well as backfill, paving and conduit, if required]). Each property owner in Underground Utility District No. 2, Division 12, shall be responsible for the installation and maintenance of the conduit and termination box located on, under or within any structure on the premises served. BE IT FURTHER RESOLVED that the Council does hereby fix as the date on which all affected utilities must have conduits, box structures and similar or associated facilities installed no later than April 1, 1986, and complete removal of all poles, overhead wires and associated overhead structures and the under- ground installation of wires and facilities for supplying electric, communication cable television or similar or associated services within Underground Utility District No. 2, Division 12, no later than September 1, 1986. BE IT FURTHER RESOLVED that the Council does hereby fix as the date on which all affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for sup- plying electric, communication cable television or similar asso- ciated service within Underground Utility District No. 2, Division 12, no later than September 1, 1986. BE IT FURTHER RESOLVED that the city Clerk is hereby instructed to notify all affected utilities and all persons own- ing real property within Underground Utility District No. 2, Division 11, of the adoption of this Resolution within ten (10) days after the date of such adoption. said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, cable television, or other simi- lar or associated service, they or such occupant shall, by the date fixed on this Resolution provide all necessary facility changes on their premises so as to receive service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission 3 of the State of California. Such notification shall be made by mailing a copy of this Resolution, together with a copy of Chapter 12.32 of the Municipal Code of the City of Bakersfield, to all affected property owners as such are shown on the last equalized assessment roll and to the BE IT FURTHER RESOLVED that determines as follows: affected utilities. the Council hereby finds and 1.
