A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD, STATE OF CALIFORNIA, ESTABLISHING
UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 11.
WHEREAS, by Resolution of Intention No. 989 adopted on
August 28, 1985, a public hearing was called for September 25, 1985,
at the hour of 7:00 p.m., in the Council Chambers in the City
Hall, Bakersfield, California, to ascertain whether the public
necessity, health, safety or general welfare require the removal
of poles, overhead wires and associated overhead structures and
underground installation o~ wires and facilities for supplying
electric, communication, cable television or similar and associ-
ated services, within that certain area, more particularly
described as follows:
DESCRIPTION
DIVISION 11
Beginning at the intersection of the south line of Ming Avenue
and the east line of Wible Road;
Thence (1) easterly along said south line o~ Ming Avenue to
intersect the east line of Hughes Lane;
Thence (2) northerly along said east line of Hughes Lane to
intersect the north line of ~ing Avenue;
Thence (3) westerly along said north line of Ming Avenue to
intersect the west line of South Real Road;
Thence (4) southerly along said west line of South Real Road to
intersect the south line of Ming Avenue;
Thence (5) easterly along said south line of Ming Avenue to
intersect the west line of Wible Road;
Thence (6) southerly along said west line of Wible Road to inter-
sect the north line of Wilson Road;
Thence (7) easterly along said north line of Wilson Road to
intersect the east line of Wible Road;
Thence (8) northerly along said east line of Wible Road to the
Point of Beginning.
Notice of such hearing has been given to all affected
property owners as such are shown on the last equalized assess-
ment roll and to all utilities concerned in the manner and within
the time required by law; and
Such hearing has been duly and regularly held, and all
persons interested have been given an opportunity to appear and
be heard.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
city of Bakersfield that, pursuant to Chapter 12.32 of Title 12
of the Municipal Code of the City of Bakersfield, the above-
described area is hereby declared an underground utility district
and is designated as Underground Utility District No. 2,
Division 11, of the city of Bakersfield. Attached hereto,
marked Exhibit "A", and hereby incorporated as a part of this
Resolution is a map or diagram entitled as follows: UNDERGROUND
UTILITY DISTRICT NO. 2, DIVISION 11, delineating the boundaries
of said District.
BE IT FURTHER RESOLVED that the electric utility which
undertakes underground installation of its facilities shall use
the underground conversion allocation computed pursuant to deci-
sions of the Public Utilities Commission of the State of
California for the purpose of providing to each premises in
Underground Utility District No. 2, Division 11, requiring it (a
maximum of one hundred feet of individual electric service
trenching and conductor [as well as backfill, paving and conduit,
if required]). Each property owner in Underground Utility
District No. 2, Division ll, shall be responsible for the
installation and maintenance of the conduit and termination box
located on, under or within any

to receive underground service, and does hereby order the removal
of all poles, overhead wires and associated overhead structures
and the underground installation of wires and facilities for sup-
plying electric, communication cable television or similar or

associated service within Underground Utility District No. 2,
Division 11, no later than September 1, 1986.
BE IT FURTHER RESOLVED that the City Clerk is hereby
instructed to notify all affected utilities and all persons own-
ing real property within Underground Utility District No. 2,
Division 11, of the adoption of this Resolution within ten (10)
days after the date of such adoption. Said City Clerk shall
further notify said property owners of the necessity that, if
they or any person occupying such property desire to continue to
receive electric, communication, cable television, or other simi-
lar or associated service, they or such occupant shall, by the
date fixed on this Resolution provide all necessary facility
changes on their premises so as to receive service from the lines
of the supplying utility or utilities at a new location, subject
to applicable rules, regulations and tariffs of the respective
utility or utilities on file with the Public Utilities Commission
of the State of California. Such notification shall be made by
mailing a copy of this Resolution, together with a copy of
Chapter 12.32 of the Municipal Code of the City of Bakersfield,
to all affected property owners as such are shown on the last
equalized assessment roll and to the affected utilities.
BE IT FURTHER RESOLVED that the Council hereby finds and
determines as follows:
1. That the public necessity, health, safety or general
welfare requires the removal and undergrounding of poles, over-
head wires and associated overhead structures within Underground
Utility District No. 2, Division 11.
2. The Underground Utility District herein created is
in the general public interest for the reason that the streets,
roads or rights-of-way in the District are extensively used by
the general public and carry a heavy volume of pedestrian and
vehicular traffic.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
