HomeMy WebLinkAboutRES NO 133-85RESOLUT I 01~1 NO. 133-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD APPROVING THE FILING OF APPLICATIONS FOR GRANT FUNDS UNDER THE REGIONAL COMPETIVE PROGRAM OF THE 1984 CALIFORNIA PARK AND RECREATIONAL FACILITY ACT AND THE ROBERTl-Z-BERG-HARRIS URBAN OPEN SPACE AND RECREATION PROGRAM FOR THE ACQUISITION, DEVELOPMENT AND IMPROVE- MENTS OF PARKS NEAR HARRIS ROAD AND AKERS ROAD AND STOCKDALE HIGHWAY AND JENKINS ROAD. WHEREAS, the People of the State of California have enacted the California Park and Recreational Facility Act of 1984 which provides funds to the State of California and its political subdivisions for acquiring lands and developing facilities for public recreational purposes; and WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility for the administration of programs under said Act setting up necessary procedures governing application by local agencies under the program; and WHEREAS, said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of applications prior to submission of said applications to the State; and WHEREAS, said applications contain a certification that the applicant will comply with all federal, state, and local environmental, public health, relocation, affirmative action, and clearing-house require- ments and all other appropriate codes, laws and regulations prior to the expenditure of the grant funds; and WHEREAS, the projects applied for under these programs must be of a high priority and satisfy the most urgent park and recreation needs with emphasis on unmet needs in the most heavily populated areas. WHEREAS, the applicant agency will enter into an agreement with the State of California for the development of the projects. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby: I. Approves the filing of applications for 1984 State Grant assistance for the above projects. 2. Certifies that said agency has or will have sufficient funds to operate and maintain the projects funded under these programs; and 3. Certifies that said agency understands the assurances and certifications in the application; and 4. Certifies that said agency has or will have available prior to commencement of any work on the projects included in these application matching money from a nonstate source; and 5- Certifies that the projects included in these applications conform to the park policy contained in the Open Space Element of the applicable City general plan; and 6. Certifies that said agency will provide construction plans and specifications to the State within one (1) year of the appropriation of funds under these programs and will commence work immediately after State approval; and 7- Appoints the City Manager as agent of the City to conduct all negotiations, execute and submit all documents including but not limited to applications, agreements, amendments, payment requests, and so on which may be necessary for the completion of the aforementioned pro- jects; and 8. Appoints Richard J. Oberholzer as legal counsel of the City for purposes hereof. .......... 000 ..........
