A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT VI OF PRO- POSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 2-85). WHEREAS, the Council of the City of Bakersfield referred Segment VI of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission ot the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on June 20, 1985, on Segment VI of a proposed amendment to the Land Use Element o~ the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by pub- lication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment VI of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: Segment VI: HARRIS ROAD GROUP has applied to change the Low Density Residential (0.5 to 5.49 dwelling units per gross acre) designation for 60 +/- acres to Industrial for property generally located south o~ Harris Road, west of Freeway 99 to Wible Road. WHEREAS, tor the above-described Segment, an Initial Study was conducted, and it was determined that, with mitigation measures incorporated as conditions in the project and accepted by the applicant, the proposed project would not have a signifi- cant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 132-83 have been duly fol- lowed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 90-85 on June 20, 1985, the Planning Commission recommended approval and adoption of Segment VI by this Council and this council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on August 28, 1985, on the above-described Segment VI of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given an least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general cir- culation. NOW, THEREFORE, BE IT RESOLVED of the City of Bakersfield as follows: and found by the Council 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment VI is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts Segment VI of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, subject to the following six (6) conditions incorporated in the project description and agreed upon by the applicant: 2 Within ten (10) days of the adoption of the zone change resolution, the owner shall dedicate an addi- tional 25 foot right-of-way along the east side of Wible Road from the north line of Tract 4060 to Pacheco Road. A six-foot masonry block wall is required along the south property line of the proposed project where uses allowed under proposed zoning directly abut residential uses. Areas separated by open canal and/or sump areas shall not require block walls at this time. No two-story structure shall be constructed or located within 65 feet of any property zoned or used for residential purposes. D. Noises on the site shall not exceed the ambient noise level. A 100-foot-wide open area, including the existing open canal, shall be retained along the southern property line. Developer shall construct curb, gutter and street paving to arterial standard on the east half of Wible Road from Panama Lane to Pacheco Road. This shall include the unpaved portion of Wible Road adjacent to Tract 4060 and widening of the canal crossing as required by the City Engineer. These improvements will be required prior to issuance of the first building permit or recordation of a new subdivision map. 5. Satisfaction of the conditions set forth above shall be accepted by the City as full satisfaction of the contemplated Site Plan Review Policy for Local Off-Site Improvements as to all structures for which building permits have been issued within three (3) years of the date of this Resolution. 6.
