HomeMy WebLinkAboutRES NO 124-85RESOLUTION NO. 124-85 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, STATE OF CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 2, DIVISIONS 9 AND 10. WHEREAS, by Resolution of Intention No. 985 adopted on July 24, 1985, a public healring was called for August 28, 1985, at the hour o~ /:00 p.m., in the Council Chambers in the City Hall, Bakersfield, California, to ascertain whether the public necessity, health, safety or general welfare require the removal of poles, overhead wires and associated overhead structures and underground installation of wires and ~acilities for supplying electric, communication, cable television or similar and associ- ated services, within that certain area, more particularly described as follows: DESCRIPTION A DIVISION 9 Beginning at the intersection of the north line of Panama Lane and the east line of Wible Road; Thence (1) northerly along said easterly line o~ Wible Road to intersect the south line of Pacheco Road; Thence (2) easterly along said south line o~ Pacheco Road to intersect the westerly line ot Freeway 99; Thence (3) northerly along said westerly line o~ Freeway 99 to intersect the north line ot Pacheco Road; Thence (4) westerly along said northerly line ot Pacheco Road to intersect the easterly line of Wible Road; Thence (5) northerly at right angles along said easterly line of Wible Road 1,300'; Thence (6) westerly at right angles 110' to intersect the west- erly line of Wible Road; Thence (7) southerly along the last-named westerly line 1,325'~ to intersect the north line of Pacheco Road; Thence (8) westerly along said north line of Pacheco Road 1,300'; Thence (9) southerly at right angles 90' to intersect the south line ot Pacheco Road; Thence (10) easterly along the last-named south line to intersect the west line o~ Wible Road; Thence (11) southerly along said west line of Wible Road to intersect the north line of Panama Lane; Thence (12) easterly along said north line of Panama Lane to the point o~ beginning. DESCRIPTION B DIVISION 10 All that portion of Wible Road located within Section 13 and 14, Township 30 South, Range 27 East bounded on the north by a line 575 feet South of and parallel with the South right-of-way line of Planz road, and on the south by a line 1,300 feet north of the intersection of the East line of Wible Road and the North line of Pacheco Road and being parallel with the North right-of-way line of Pacheco Road. Notice of such hearing has been given to all affected property owners as such are shown on the last equalized assess- ment roll and to all utilities concerned in the manner and within the time required by law; and Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to appear and be heard. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that, pursuant to Chapter 12.32 of Title 12 of the Municipal Code of the City of Bakersfield, the above- described area is hereby declared an underground utility district and is designated as Underground Utility District No. 2, Divisions 9 and 10, of the City of Bakersfield. Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this Resolution is a map or diagram entitled as follows: UNDERGROUND UTILITY DISTRICT NO. 2, DIVISIONS 9 AND 10, delineating the boun- daries of said District. BE IT FURTHER RESOLVED that the Council does hereby fix as the date on which all affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for sup- plying electric, communication cable television or similar or associated service within Underground Utility District No. 2, Divisions 9 and 10, no later than July 1, 1986. 2 BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and all persons own- ing real property within Underground Utility District No. 2, Divisions 9 and 10, of the adoption of this Resolution within ten (10) days after the date of such adoption. Said city Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, cable television, or other simi- lar or associated service, they or such occupant shall, by the date fixed on this Resolution provide all necessary facility changes on their premises so as to receive service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution, together with a copy of Chapter 12.32 of the Municipal Code of the city of Bakersfield, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. BE IT FURTHER RESOLVED that the Council hereby finds and determines as follows: 1. That the public welfare requires the removal necessity, health, safety or general and undergrounding of poles, over- head wires and associated overhead structures within Underground Utility District No. 2, Divisions 9 and 10. 2. The Underground Utility District herein created is in the general public interest for the reason that the streets, roads or rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. .......... o0o ..........
