A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD ADOPTING "THE KERN RIVER
PLAN" AS AN ELEMENT OF THE BAKERSFIELD
METROPOLITAN AREA GENERAL PLAN.
WHEREAS, Section 65303 of the Government Code of the State of
California provides that general plans may include elements deal-
ing with subjects other than those specified by law which, in the
judgment of the planning agency, relate to the physical develop-
ment of the county or city;
and
WHEREAS, Section 65301(b) of the Government Code of the State
of California provides that the general plan may be adopted as a
single document or as a group of documents relating to subjects
or geographic segments of the planning area;
and
WHEREAS, the City Council of the City of Bakersfield and the
Board of Supervisors of the County of Kern directed that a con-
sistent uniform plan be prepared for the Kern River from the
mouth of the Kern Canyon to Interstate Freeway 5 to be adopted by
both jurisdictions;
and
WHEREAS, city and
county planning staffs, working with other
affected agencies and interested persons, jointly drafted a
Kern River Plan Element (hereinafter the "Plan") and proposed its
adoption as an element of the general plans of both jurisdic-
tions;
and
WHEREAS, the Board of Supervisors of the County of Kern duly
constituted the Kern County Planning Advisory Committee, Kern
River Plan (hereinafter "Advisory Committee");
and
WHEREAS, an initial study of and proposed Negative
Declaration for the Plan were distributed in late 1983 to 31
local agencies and groups, to the State Clearinghouse, and to the
Main (Beale Memorial) Branch of the Kern County Public library;
and

and
WHEREAS, the aforesaid Negative Declaration was posted on
1984, and, on that date, advertised for hearing on
1984, together with the hearing on the Plan;
WHEREAS, the Planning Commission and Advisory Committee con-
ducted a duly noticed joint public hearing to consider the Plan
and Negative Declaration therefor on March 27, 1984, continued to
April 3, 1984, to April 10, 1984, to May 8, 1984 and to May 24,
1984.

WHEREAS, the Planning Commission and Advisory Committee found
that the proposed negative declaration was prepared in compliance
with the California Environmental Quality Act and local guideli-

and
WHEREAS, as a result of public comment at the hearing and
staff evaluation, certain proposals to amend the Plan were made
at the conclusion of the hearing and that the Plan, with those
proposals, was forwarded to the Board of Supervisors of the
County of Kern and the Council of the City of Bakersfield with
recommendation to certify the Negative Declaration and adopt the
Plan with the proposed amendments;
and
WHEREAS, the Board of Supervisors conducted its duly noticed
public hearing of the Plan on August 27, September 10 and October
8, 1984 to consider testimony for and against the Plan and the
Negative Declaration;
and

WHEREAS, at the conclusion of its hearing the Board of
Supervisors adopted Resolution No. 84-622 approving the Plan with
amendments and the Negative Declaration, which were forwarded
to the City Council as Exhibit A to Resolution No. 84-622;
and
WHEREAS, the City Council conducted a duly noticed public
hearing on December 19, 1984 to consider testimony for and
against the Plan and the Negative Declaration as approved by the
Board of Supervisors;
and
WHEREAS, at the conclusion of that hearing, the City Council
took the matter under advisement;
and
WHEREAS, at its regular meeting of April 24, 1985, the City
Council approved the Plan with amendments requested by public
testimony and staff;
and
WHEREAS, that approved version of the Plan was sent to the
Board of Supervisors for concurrence;
and
WHEREAS, the Board of Supervisors at its regular meeting of
July 22, 1985, certified and adopted the Negative Declaration and
adopted the Plan, as previously approved by the City Council, as
an element of the Kern County General Plan by Resolution 85-443.
NOW, THEREFORE BE IT RESOLVED, that
The findings of Planning Commission Resolution No.
are hereby determined to be true and correct and
are adopted by reference thereto;

The Negative Declaration prepared for the Kern River Plan
is hereby certified and adopted; and
The Kern River Plan, attached hereto as Exhibit A,
hereby adopted as an element of the Bakersfield
Metropolitan Area General Plan.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 14th day of August, 1985, by the fol-
lowing vote:
