A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD PROVIDING FOR THE COLLECTION OF
REFUSE CHARGES BY THE COUNTY TAX COLLECTOR.
WHEREAS, on August 15, 1984, the City Council of the
City of Bakersfield duly passed and adopted Emergency Ordinance
No. 2933 New Series specifying annual charges upon single-family
dwellings, duplexes, triplexes and fourplexes for the collection
and disposal of refuse; and
WHEREAS, Section 50 of the Charter of the City of
Bakersfield and Section 51334 of the Government Code of the State
of California permit the City Council to provide for the collec-
tion of such charges by the County Tax Collector; and
WHEREAS, Section 8.32.100 B. of the Bakersfield
Municipal Code requires that such refuse charges be submitted to
the Kern County Auditor-Controller and Tax Collector for place-
ment of such charges as assessments on the secured roll of the
County to be collected in the same manner as ad valorem property
taxes.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
The Council of the City of Bakersfield transfers the
function of collection of refuse charges for all single-family
dwellings, duplexes, triplexes and fourplexes to the County Tax
Collector pursuant to Section 8.32.100 B. of the Bakersfield
Municipal Code to be billed at the time of billing for property
taxes. Such charges shall be in the amounts specified in
Emergency Ordinance No. 2933 New Series.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regu-
lar meeting thereof held on the 24th day of July , 1985, by

AN EMERGENCY ORDINANCE OF THE COUNCIL OF.
THE CITY OF BAKERSFIELD AMENDING SECTIONS
8.32.030 A. 1.~ 8.32.030 B., AND 8.32.030
C. OF THE nAKERSWIELD MUNICIPAL CODE
P~LATING TO REFUSE COLLECTION CHARCES.
WHEREAS, Emergency Ordinance No. 2880 New Series, effective
October 12, 1983, ~mended Sections 8.32.030 A. ]., 8.32.030 B. and
8.32.039 C. of the Bakersfield Municipal Code to establish monthly
refuse collection charges applicable to single-family dwellings,
multiple-family dwellings, and other uses, which monthly charges
were ~alculated by dividing the annual charges for refuse collection
services by the ten (]0) months remaining in fiscal year 1983-84;
and
WHEREAS, utilization of the monthly charges specified in
the Sections 8.32.03~ A. ]. and 8.32.030 B. fer the entire 1984-85
fiscal year would result in higher annual refuse collection charges
than intended; and
WHEREAS, pursuant to Section 8.32.100 B. of the Bakersfield
Municipal Code, charges imposed under that Chapter upon single-
~amily dwellings, duplexes, triplexes and fourplexes are to be
collected by the Kern County Tax Collector with property taxes,
and setting forth such charges as annual, rather than monthly,
charges is appropriate; and
WHEREAS, adopt~on of this ordinahce as an emergency
ordinance is necessary for the immediate preservation of property
and for generation of revenues for the daily operation of a municipal
department.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION !.
Sections 8.32.030 ~. 1., 8.32.030 B. !., 8.32.030 B. 2.,
and 8.32.030 C. of the Bakersfield Municipal Code are hereby
amended to read as follows:
B. 1.
Dollars ($14.00)
2.
Seventeen Dollars ($17-00) annual charge;
For duplexes, triplexes and fourplexes, Fourteen
per dwelling unit annual charge;
For complexes of more than four dwelling units,
One Dollar and Forty Cents ($1.40) per dwelling uni~ monthly
charge, with the use of standard containers and twice per week
pickups.
C. For all other uses, properties utilizing detachablc
bins, more than two standard containers, and/or more than twice
per week pickups, the monthly charges set forth in Schedules A and
B, Sections 8.32.040 and 8.32.050, as applicable.
SECTION 2.
This Emergency Ordinance is necessary for the i~nediate
preservation of the public health, peace, property and safety
and shall become effective in%mediately upon its passage.
