HomeMy WebLinkAboutRES NO 81-85RESOLUTION NO. 81-85 A RESOLUTION OF APPLICATION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 301 (FAIRVIEW NO. 2). WHEREAS, the city of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 35140 of the Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the Council of the city of Bakersfield that it hereby finds and determines as follows: 1. That this proposal for change of organization, to wit, annexation, is made pursuant to the Municipal Organization Act of 1977 (Part 2 of Division 2 of Title 4 of the Government Code of the State of California, commencing with Section 35000 thereof), and it is requested that proceedings be authorized for annexation in accordance therewith. in accordance with is marked as though 5. That zoning upon annexation of FAIRVIEW NO. 2 shall be considered in separate proceedings, including analysis of environmental impacts, and that the environmental impacts of the annexation will be evaluated by the Local Agency Formation Commission of Kern County, as lead agency, during its proceedings. 7. Library _ N/A Streets Sweeping Lighting Sewer Constrnction/Maintenance - The City Corporation Yard on Truxtun Avenue west of Freeway 99 will provide necessary facilities, personnel and services to accomodate Public Works efforts. Maintenanc~ and personnel will be dispatched from the · City Yard on a regular basis for preventa- tive maintenance as needed. Repair includes streets, constructed/maintenance, sweeping and lighting. - Connection to City sewer may be made to Midas Street and Panama Lane trunk lines. Effluant would then be treated by the City Wastewater Treatment Plant #3. Other (Water) - this area is served by the California Water Service Co. Indicate frcquegcy and availability of Service (i.e.,street sweepi.g~ response tim for cntergency service_s, rec. ~rogr_aLn~_ctc. 24-hour patrol is provided in the imme- diate vicinity of this annexation] First priority response is approximately 5.46 minutes or less. Fire protection'is provided on a 24-hour basis with response time of 5 minutes or less. The annexation will not affect City fire service capability. ! Indicate and explain proposed prezoning in area. (List effects on present land use that would occur as a result of annexation such as maintenance of livestock on property, etc.) Fairview No. 2 is fully developed into 165 R-1 lots and 32 E-1 RS lots. The City's R-1 and R-S pre-zoning are compatible and consistent with the existing zoning and with the adopted Metropolitan Area Genegal Plan. There would be no effect on the present land use. List city services that area will directly or ina~rectly benefit from such as decrease in fire insurance rate, shorter emergency response time, use of com- munitX facilities, etc. City police should be able to respond in a mnra timely manner than the present County Sherrif and State Highway Patro. Current City Police standard is 1.65 sworn officers per 1,000 population compared to the County standard of 1.15. The City will provi3~ ~trapt maint~nnDce which includes street sweeping. The proposal is to annex a 54 acre county island located at the south- east corner of South H Street and Fairview Read to the City of Bakersfield. The island is entirely developed into a 197 detached single family home neighborhood.
