HomeMy WebLinkAboutRES NO 79-85RESOLUTION NO. 79-85 A RESOLUTION OF APPLICATION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 302 (HUGHES NO. 2). WHEREAS, the city of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 35140 of the Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the Council of the city of Bakersfield that it hereby finds and determines as follows: 1. That the City of Bakersfield hereby proposes the annexation to the City of Bakersfield of the territory described in Exhibit "A", attached hereto and made a part of this resolu- tion as though fully set forth herein. 2. That a map of the territory proposed to be so annexed, marked Exhibit "B", is attached hereto and made a part of this Resolution as though fully set forth herein. 3. That a Plan for providing services within the affected territory of the proposed annexation, in accordance with the provisions of Section 351.02 of the Government Code, is marked as Exhibit "C", attached hereto and made a part hereof as though fully set forth herein. 4. That this proposal for change of organization, to wit, annexation, is made pursuant to the Municipal Organization Act of 1977 (Part 2 of Division 2 of Title 4 of the Government Code of the State of California, commencing with Section 35000 thereof), and it is requested that proceedings be authorized for annexation in accordance therewith. 5. That the reasons for the proposed change of organi- zation are that the owners of the affected territory desire to receive municipal services from the City of Bakersfield, and the City desires to receive tax revenues for benefits given and to be given to the territory proposed to be annexed. 6. That zoning upon annexation of HUGHES NO. 2 shall be considered in separate proceedings, including analysis of environmental impacts, and that the environmental impacts of the annexation will be evaluated by the Local Agency Formation Commission of Kern County, as lead agency, during its proceedings. 7. Station 5 is located approximately 2 miles northeasterly at Planz Road and So. Chester Avenue. Parks and Recreation _ Planz Park is located approximately 1-1/2 miles northeasterly of the annexation. Lihrary - N/A Streets Constrnction/Maintenance - The City Corporation Yard on Truxtun Avenue west of Freeway 99 will provide necessary facilities, personnel 24-hour patrol is provided in the immedi- ate vicinity of this annexation. First ~riority response is approximately 6.35 minutes or less. Fire protection is provided on a 24-hour basis with response time of 3-1/2 minutes. All City parks are open to the public at reasonable hours. There will be no reduction in the range capacity of the City' to provide the and services to accomodate Public Works efforts. Maintenance Sweeping personnel will be dispatched from the City Yard on a regular basis for preventative maintenance as needed. Repairs include: Street maintenance and reconstruction, sweeping Lighting and maintenance and utility costs of street lighting, if requested and installed. - Connection to the City sewer may be made in Hughes Lane. Effluent would then be treated by the City Wastewater Treat- ment Plant 3. Other N/A necessary public works services to this area. Services will be on a regular basis and "as needed". With the present expansion ~f Plant 3, adequate capacity exists. The annexation of this territorv will not affect near term level or capability of the City to provide needed services. IV. Would city require any upgrading or change in facili{ies to serve affected terri- tory (roads, fire hydramrs, mains, etc.)? If so, would city or residents be responsible for financing? The City will not require any upg-~ding or changes in existing facilities. Should the residents o~ Mughes No. 2 want area w~de sewer service and-street lights, the City will assist them in~establishing a public improvement district to finance installation of these improvements. (List effects on present land u~e that would occur as a result of annexation such as maintenance of livestock on property, etc.) Hughes No. 2 is fully developed into 157 R-1 lots and 69 M-S lots. The City's R-l, M-11 and R-1-CH prezoning are compatible and consistent w~th the existing zoning and with the Metropolitan Area General Plan. There would be no ef±ect on the present land use. VII. Traffic intensity and patterns will not be changed by annexation. Briefly describe the proposed project. (Attach additional sheets if necessary). The proposal is to annex a ]~ acre county island located at the south- east corner of Freeway 99 and Pacheco Read to the City of Bakersfield The island is entirely developed into a 240 existing single family detached home neighborhood. There is one church located in the annexation.
