RESOLUTION AUTHORIZING FINANCE
DIRECTOR TO DISPENSE WITH FORMAL
BIDDING REQUIREMENTS REGARDING
OIL, GAS, ASPHALT, CEMENT AND OTHER
OIL OR CONSTRUCTION RELATED
MATERIALS NEEDED FOR NORMAL
OPERATIONS OF THE CITY FOR THE
REMAINDER OF THE 2005-06 FISCAL
YEAR.
WHEREAS, Bakersfield Municipal Code Section 3.20.100 provides that the
Finance Director may dispense with formal bidding requirements for certain public
works projects, or supplies, equipment and materials for the same when the estimated
value of such is $25,000 or less; and
WHEREAS, the rapid expansion of the construction industry in and around
metropolitan Bakersfield, combined with the recent and drastic increases in raw
materials such as oil and gas caused by a rapidly expanding global demand, as well as
the dramatic effects of Hurricane Katrina, have made it impossible in many situations for
the Finance Director to purchase certain basic materials for the normal, day-to-day
operation of the City such as oil, gas, asphalt, and cement, for prices that had
previously been under $25,000; and,
WHEREAS, the Council hereby determines due to the extraordinary and
devastating conditions caused by Hurricane Katrina and its resultant impacts on the
economy, that in order for the City of Bakersfield to operate efficiently, the Finance
Director must be granted temporary power to make the above-described purchases,
without formal bidding; and
WHEREAS, this Council wishes to authorize the Finance Director to make
purchases of oil, gas, asphalt, cement, and related products needed for the normal day-
to-day operations of the City, without having to comply with the normal bidding
procedures of the Bakersfield Municipal Code.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals and findings are true and correct and are incorporated
herein by reference.
2. The Finance Director is authorized to make purchases for oil, gas, asphalt,
cement, and related products necessary for the normal, day-to-day operations of the
City, not to exceed budgeted amounts for these products, without complying with the
formal bidding requirements.
3. The authority granted by Paragraph 2 shall commence immediately and
extend through June 30, 2006.
