The appeal must be filed in writing within 10 days from date of the Boards hearing with the City Council, c/o City Clerk; 1501 = Truxtun Avenue; Bakersfield, CA 93301. Appellants, except those within the public notice area, must include a $675 non-refundable filing fee with the appeal. If all appeals are withdrawn before the City Councils meeting, they will not hear the item and the Boards decision will become final. == The City will not issue any permit, license or other approval for a use involved in an application until after the appeal period has closed. If the City Clerk does not receive an appeal within the 10- day period, the Boards decision will become final. = 2. Horton has requested a Conditional Use B (Ward 5) Permit to allow a 16,121 sq. ft. private park to serve Tract 6303 located in an R-1 zone at 10202 Titanium Avenue Staff Recommendation: Approve 2) FILE NO. 05-1166 New Cingular Wireless has requested a B (Ward 3) Conditional Use Permit to allow a 65 foot tall monopine with a 322 ± sq. ft. equipment shelter on a 1,490sq. ft. site of an existing church site within an R-1 (One Family Dwelling) zone district at 3205 Fairfax Road. Staff Recommendation: Approve B.MODIFICATIONS 1) FILE NO. 05-1146 Artimus Powell has requested a one-year B (Ward 7) extension of time to an approved Modification (#04-0951). That reduced the north and east building setback from 50 feet to 25 feet for a proposed two-story, 12 unit apartment complex within an R-3 (Limited Multiple-Family Dwelling) zone district at 1500 Hughes Lane.
