BOARD OF ZONING ADJUSTMENT
OF THE CITY OF BAKERSFIELD
Held Tuesday, January 11, 2005, 3:00 p.m., City Council Chamber, City Hall, 1501 Truxtun
Avenue, Bakersfield, California.

MINUTES OF PREVIOUS MEETING

Motion was made by Member La Rochelle, seconded by Member Gonzales to approve minutes of
the meeting held December 14, 2004. Motion carried.
PUBLIC HEARING – 9401638 – TIM SULLIVAN HAS REQUESTED A CONDITIONAL
4.A.1.
USE PERMIT TO CONSTRUCT A 1,400 SQ. FT. DRIVE-THRU CARWASH
ACCESSORY TO A PROPOSED CONVENIENCE MARKET WITH FUEL PUMPS
WITHIN A C-1 NEIGHBORHOOD COMMERCIAL) ZONE LOCATED AT 6009
COFFEE ROAD.

Public hearing opened for comments. No one spoke in opposition or in favor. Public hearing was
closed.
Motion was made by Member LaRochelle to adopt the resolution with all findings and conditions,
approving Conditional Use Permit #04-1638 as depicted in the project description. Motion
carried by the following roll call vote:
AYES: Members La Rochelle, Gonzales, Leonard

4.A.2) FILE NO. 04-1656 – PAUL POWELL REQUESTED A CONDITIONAL USE PERMIT
TO CONSTRUCT 2 DUPLEXES, TOTALING 4,256 SQ. FT. WITHIN A C-1
(NEIGHBORHOOD COMMERCIAL) ZONE LOCATED AT 807 R STREET.

Public hearing opened for comments. There was no one wishing to speak in opposition or in
favor. Public hearing was closed.
Member Gonzales asked the applicant if he were amenable to shifting the corner unit to face R
Street.
Applicant, Paul Powell would not prefer to do that, but if he had to, he would.
Chairman Leonard asked if the narrow side of the lot to be the front door was an ordinance
requirement.
Staff planner, Jim Eggert replied that it is an ordinance requirement in the R-2 zone and was being
recommended to be consistent with other new multi-family developments . However, it is
subjective and the Board has the discretion to alter the design as appropriate.
Motion was made by Member Gonzales to adopt the resolution with all findings and conditions,
approving Conditional Use Permit No. 04-1656 subject to the designed proposed by applicant.
Motion carried by the following roll call vote:
AYES: Gonzales, La Rochelle, Leonard
NOES: None
ELECTION OF CHAIRPERSON FOR 2005.

representative). Motion carried by the following roll call vote:

There being no further business to come before the Board, meeting was adjourned at 3:20 p.m.
