RESOLUTION MAKING FINDINGS, APPROVING THE
NEGATIVE DECLARATION AND ADOPTING GENERAL PLAN
AMENDMENT 04-2005 AN AMENDMENT TO THE
CIRCULATION ELEMENT OF THE METROPOLITAN
BAKERSFIELD GENERAL PLAN AND ADOPTION OF THE
WASHINGTON STREET SPECIFIC PLAN LINE.
WHEREAS, the Planning Commission of the City of Bakersfield in accordance with the
provisions of Section 65353 of the Government Code, held a public hearing on MONDAY,
JUNE 13, 2005 and THURSDAY, JUNE 16, 2005, on General Plan Amendment 04-2005 of the
proposed amendment to the Circulation Element of the Metropolitan Bakersfield General Plan
and the Washington Street Specific Plan Line, notice of the time and place of hearing having
been given at least twenty (20) calendar days before said hearing by publication in the
Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, Case No. 04-2005 an amendment to the Circulation Element of the
Metropolitan Bakersfield General Plan and the Washington Street Specific Plan Line is as
follows:

The City of Bakersfield has applied to amend the Circulation Element of the
Metropolitan Bakersfield General Plan; Case No. 04-2005 and a Specific Plan
Line for the Washington Street alignment.
and
WHEREAS, for the above-described segment, an Initial Study was conducted and it was
determined that the proposed project would not have a significant effect on the environment
and a Negative Declaration was prepared and posted on May 10, 2005 in accordance with
CEQA; and
WHEREAS, the law and regulations relating to the preparation and adoption of Negative
Declarations as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures,
have been duly followed by the city staff and the Planning Commission; and
WHEREAS, by Resolution No. 73-05 on June 16, 2005, the Planning Commission
recommended approval of the applicant's request to amend the Circulation Element and adopt
a Specific Plan Line for Washington Street,
WHEREAS, the Council of the city of Bakersfield, in accordance with the provisions of Section
65355 of the Governmnet Code, conducted and held a public hearing on Wednesday, August
18, 2005 on the above described General Plan notice
WHEREAS, the Council has considerable and hereby makes the following findings:
1. Within the Metropolitan Bakersfield General Plan Circulation Element, the
standard collectors are 68 feet wide with 90 feet of right-of-way.

2. Washington Street is a collector.
3. The curent alignment goes thru a developed golf course.
4. The City sewer treatment plant exists to the east of the propsed alignment.
5. It is necessary to accurately locate the right-of-way in order to allow for coherent
planning in the area of the Specific Plan Line.
6. No part of this alignment has been constructed, and there is no apparent reason
for this portion of the alignment to deviate that much from the mid-section line.
7. All required public notices have been given.
8. The provisions of the California Quality Act have been followed.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED AS FOLLOWS:
1. The above recitals, incorporated herein, are true and correct.
2. The Negative Declaration for Case No. 04-2005 is hereby approved.
3. As to Case No. 04-2005, an amendment to the Circulation Element, consisting
of the change as shown on attached map (Exhibit "C") is hereby recommended
for adoption, and recommend same to City Council.
4. That the exact alignment for the Washington Street Specific Plan Line as
depicted in Exhibit "B" and described in Exhibit "A" is hereby recommended for
adoption, and recommend the same to the City Council.

EAST, MOUNT DIABLO BASE AND MERIDIAN, IN THE INCORPORATED AREA OF THE
